ok, after finding that mister was lying to me and addicted to on line porn and a kind of engaged into some young girl lurking...beurkkk.

revolting

and blabla..

and then we got seperated, and we are going through divorce.

the thing is that, i am 8 month and half pregnant, with no income and i would like to know

1-how can I do to make him responsible what he signed for, as for the affidavit of support

Of course he denies me any kind of financial support

2-Anyone has already filed a complaint or something concerning the affidavit of support? any experience in that matter is welcome.

Marriage: 01-26-2032

Divorce: 10-13-2032

You would have to file for divorce assuming you married him. In the divorce process he will be ordered to pay child support. Or if not married you can file for child support after the child is born.

yes, we are married and very soon divored, hopefully. The idea of still ebing married to that guy just want to make me vomit all over the table.

but yor answer is about the divorce frame. which is one thing.

i was talking about the affidavit of support which is besides the divorce if not beyond the divorce process.

So i wanted to know how we can make that affidavit of support operational in real and not only on papers.

there is no spousal support in the divorce, but the affidavit of support, is a support to someone.terminated marriage or not.

Sadly - it's not that cut and dried.

The 864 allows the government the ability to sue the sponsor for any means tested benefits that you would use.

It allows appears to let the beneficiary use it to sue the sponsor - however, there have only been a few cases using this path, so you would be on new ground.

In the one case, the benificiary was able to get the sponsor to give her the difference between what she was earning and what the poverty level was for one person @125%. ( here are links and another case)

You would need to get a lawyer and start the process of suing based on the 864.

Your best bet is to get a divorce settlement (based on marriage) - and if that is not enough, to pursue the 864 thing.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

There have been spousal support judgements based on the I-864. That type of judgement happens in the courts, not through the USCIS. (Bobby gave you the links)

As others have stated, consult a family law attorney that has experience in this circumstance.
