Hi to all VJ members,

Glad to be a newbie here.

Just i am curious, anybody can help?. Last June both our I-130 and I-129F petitions approved by NVC, we were so confused that time since they approved my I-129F first and mailed us the NOA2 in 2days span of time I-130 approval mail follows, we opted to proceed with I-130 NVC path paying AOS and IV bill, and right now we are waiting for SIF/CC, just i am confused, since the embassy sent us notice that we can now proceed with K3 to schedule for interview last July and we just disregard it, would it affect our I130? or i have to call the embassy to informed them that we opted to proceed with I-130. not sure if the NVC closed our K3 already as we already proceed with our I-130. Thankyou so much in advance for inputs. Godbless us all!

You can just ignore anything you receive from the embassy regarding the K3. Keep sending the NVC anything they ask for the I-130. Once they complete your case, they'll send it to the US embassy after they make an appointment date with them and then you'll interview for a CR1 visa.

07/20/11 - Oath ceremony - same day as interview

If the Embassy is sending you stuff about the K-3, then the I-129F was not administratively closed at NVC.

At this point, if yer wanting to pursue the IR-1/CR-1 visa, you can send an email to the Embassy, asking them to close the K-3 casefile, stating the MNL casefile # of the CR-1/IR-1 visa application at NVC.

HOWEVER, even with that said - IF there are any children involved, that might be coming in on a K-4 visa, and IF seperate I-130's were NOT submitted on THEM with the initial I-130 submittal on the spouse -

then it makes sense to pursue the K-3, as the K-4, derivative visas, can be awarded on the same day at the US Embassy in Manila. Then spouse and children can travel together to USA. Otherwise, keeping all 'IR-1/CR-1' visa, at this point, requires a new filing , need new I-130's submitted for each child.

thank you guys for your kind response. We did pursued CR1 visa already, right waiting for CC/SIF, might call embassy to have K3 closed, hopefully we have our case complete soon for CR1.
