hey frindes /

i got a mail since 3 days from uscis and my quiz is did we still can have a visa or what will be next and if they will approve it did when they can answer me and what will happened if they approve it did they will send it back to american embassy at cairo or what ??

did any any body happened to him the same at his case and still got the visa ????

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

hello, my case was also send back to uscis and today i check the status online:-

Our first petition ( K1 CSC) was sent back after the embassy sat on it for 4 months. At that time CSC would consistently wait 120 days and then tell you that they declared your petition expired and you were free to refile. That still seems the trend with K1 visas. You can actually take a preemptive strike and file a new , improved better K1 and self declare the first petition as expired ( a statement of presumption in your cover letter) and just push forward. This is what we did.

As to an IR/CR1 they are a different animal but you are most likely looking at 120+ days before they do much ( which is how long they will tell you you have to wait before filing a service request.

This will not be over quickly. You will not enjoy this.

when the petiton can expire , did they use the the noa1 date ???? or noa2 date ??? or which date ???

what did you do after your k1 expired ?? what kind of process you choose to do and did it work ? , also did you know the reason they sent your case back or just the simple letter to your sentor which said : the fiancee dont show a bona fide relationship to his fiancee so we sent the case back to adijaction , or did you got another letter

With a K1 your Noa2 states that the approval has a validity of 4 months. So if your petition is returned after those 4 months have expired you can refile on a presumption of the first petition having expired. Even if the embassy extended it due to a late interview.

Does your Noa2 have the same statement ?

Any returned petition if you call USCIS and push all the buttons to get a human they will tell you to wait until 180 days have passed since they received it. The longest days ever. Then you can file a service request and get an answer as to what they are doing with it.

This will not be over quickly. You will not enjoy this.

Thanks for your information. To clear myself, are you saying that the validation date on the NOA2 is effective if the visa denied and the case returned back to the USCIS via NVC? So you are advising to refile another I-129F petition if that day over passed even before the USCIS send me any notification. My petition expired by Sept. 20 and NVC didn't received the package from the embassy yet. It is really very confusing what to do. Thank you for sharing your experience.

I have been through this twice.. two times NVC sent my case back to USCIS for review. On second time we got senetor's help, and it helped a lot.

Usually it is some mistake or not enough information passed by USCIS to NVC so they send it back. Sometimes it is a red flag that NVC noticed and they want USCIS to review it.

So basically your case is back in NOA1 stage. You will have to wait for few months to get your case reaffirmed or revoked. You can get senetor or congressman's help to get the info.

And dont worry about your Petition expiration date. They will extend it once they reaffirm your case.

Hello yajakass...what kind of help did you got from senator? Had you scheduled an appointment with senator and then walked senator thru? Please provide me details, as my case also sent back to USCIS. I haven't received amended NOA2 yet but can expect sometime soon. I did contacted my state's senator on this and his staff asked me to check with her on Friday. Will this be sufficient? You can sense lot more nervousness and frustration in my writing. Also, if possible let me know how long did it took you to get approval after review and what other actions you took along. Looking forward for your reply. Thanks in advance

some times people say the sentor help alot some people say he never do nothing so you need to try your self , god help us

How about my case? I got NOA2 aprroved on April 4th 2012. I got case number from American Embassy in Tokyo on 23rd and after ONE day they sent back my I-129F to USCIS to request. But I already got NOA2 aprroved.

I called USCIS and they said once youe I-129F is sent back, you have to wait minimum 120days. That is stupid. I already waited for NOA2 aprroved and I have to wait another 120 days?

Im in stress now.
