Hi

My mother is a green card holder and she submitted I-130 for my brother. The I-130 got approved and visa number became available in several years. The embassy in my country sent a letter to my brother to come get the visa to immigrate to the US. The problem is my brother is mentally unstable and I don't think he can handle meeting anyone in the embassy. Does anyone know the procedure inside the embassy and weather my brother's mental condition can cause a problem for him to get the visa? and if there is anything we can do??

To clarify: your brother was not told to pick up his visa, he was asked to an interview; there will also be a medical. If he passes both, he will get his visa.

Which embassy is it? The procedure and security policies differs slightly in each.In most cases, a guardian is allowed to attend the interview with the beneficiary- contact the embassy and see if a family member could attend with him, at leats go in with him (they might nt be allowed into the actual interview room).

When you say mentally unstable, what exactly do you mean? Unless he is a danger to himself or others, it is unlikely to preclude him from getting the visa, but the sponsor (your mom) may need to show at interview that she can pay for health insurance in the USA for him, if he has an illness which requires ongoing medication or treatment.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank u very much for ur response. Yea he was asked to go for an interview. by saying mentally unstable i meant he is just not normal. I mean if u talk to him it feels u r talking to a 5 or 6 years kid while he is 32 thats why i said he wouldnt be able to handle the interveiw. He also has epilepsy. He isnt dangerous to himself or others. u r right i should contact the embassy to see if someone can go inside with him..

Your brother will need to get a medical exam before the interview, a visa will not be given to him without getting this done first. The doctor conducting the exam will most likely notice your brother's condition and refer him to a specialist. The visa will depend on their diagnosis. If it's not something alarming, the CO will probably ask what kind of treatment he needs to get in the US and how your mother plans to pay for it. Just be ready for all kinds of questions from the doctors and the embassy.
