Help.. she's here on a visa can we Marry now and apply for green card?

Yeah.... going to get started on that right away. When you as for the NO OBJECTION letter do you want to be married already or stay quiet about that intention. I seem to think maybe it's better to stay quiet? But, I don't know their policy, because I know the government of El Salvador depends heavily on the support on El Salvadorians living abroad. 50% of their GDP or $ made is from money being sent from the US to their country.

Thoughts?

Why would you stay quiet?It doesn't matter if you are married or not, you may apply for that waiver. There are a lot of users on this forum who applied for that type of waiver and then they successfully completed the AOS process.

I appreciate that input. This weekend has been a tough weekend for us, because the dread or idea that maybe we will be seperated really got to us. Just that comment that others have filed for the waiver and then gotten the AOS really makes me feel better. We need to start the waiver VERY quickly.

Does anyone here have any experience for how long that can take? The links I've followed sound like it takes 6 weeks?

Whoohooo!! ES embassy granted their NOS in less than a week! :)

I had worried they would be difficult and felt like a lawyer putting together documents.

I really know this is meant to be!!!!!!

So the next step is for the USA to provide a J-1 Visa waiver and I expect a miracle to happen really quickly!!! Watch and see!!!! :dance::dance: :dance: SMILE!!

What should we do next?

I want to make sure I provide all information. She was on her J-1 Visa for 1 year... which "expired", but was extended to stay longer. I believe that extended date goes to Nov. 15th.

I'm assuming we can start the AOS process? Without ever having to leave the US?

Well you have to get married :P

If your waiver is in order, then you get married and file the necessary paperwork, I-130/I-485 and related forms... once you get your initial acceptance letter (NOA1) after about a week or so then she is legally able to stay and await the decision. Should all go smoothly. Best of luck.

HEHE... we've been working through breaking this very life changing news to our families. Now that her side is "softened" I have to break the news to my parents.

We will not be doing a traditional wedding ceremony at this time. I do not desire one with my family or believe in the expense. We will however go back to her country for a ceremony with her family sometime in the future.

IN THE MEANTIME: Any advice for the marriage liscense and JOP?

I thought about going to Vegas or actually would prefer RENO... we could marry there and enjoy a long weekend in Lake Tahoe or even drive to Sacramento or San Francisco. I did the trip last year for my buddies wedding and it is really beautiful. I've heard that Vegas is a red flag? My idea wedding is a destination wedding on a beach and really no one else there. Should we get license here and just do JOP locally?

Please provide advice.. Thanks!! :)

I've never heard about Nevada weddings being a red flag, but I wouldn't be surprised if they were. If I were going to have a Nevada wedding, and I had the choice between Vegas or Reno, I'd probably pick... Tahoe! :thumbs:

I live in the Bay Area. The beaches around San Francisco are pretty cold this time of year. A nice day would have temps in the mid 50's. If you really want a coastal wedding not far from San Francisco I think you'd like Santa Cruz or Monterey. Both are pretty popular weekend getaway destinations for couples. If you're not too set on a beach wedding then maybe you'd like a wine country holiday. There are lots of romantic bed & breakfast joints in Napa Valley.

Well.. as of 11/12/10... we are now married!!! :)

Now I am cramming this package together. It's been serious work and we NEED LOTS OF HELP!! Thank you guys!!
