Good evening everyone,

We filed for AOS back in July and after mailing it off I noticed that I forget to sign and have the affidavit notorized. I called the mis-information line to ask what I should do and they said not to worry that I would be able to do a new one at the interview. Well, this really concerns me after reading some of the other post on this site...specifically the couple who add their AOS denied because of a doctors screw up!

My question is does anyone think our AOS will be denied before we ever get an interview? Any sugestions as to what I should do?

They are now processing our date range and I'm beginning to sweat. This is terrrible because I could have submitted the document almost immediately but there seems to be no provision for doing this in the current system.

Hi can you post your timelines? So we could determine what's your status. Usually you will get RFE and you just have to follow what they want for you to send back but if they didn't most likely you will have to bring it on the interview. I hope this will work out for you.

April 25,06 started working.

Aug. 18,06 passed the colorado driving test

Sept. 28,06 got my own car

Aug. 28,12 7th year wedding anniversary

July 11,2011 became a Citizen of US

I think the issues we've seen were related to medical, when RFE was misunderstood. If USCIS sends an RFE, then you need to act. Otherwise, I'd just bring a new affidavit to the inteview.

Anyone has other opinions?

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

I think they'd send you an RFE if they wanted the I-864, before they actually denied you. So when and if they do that, then just send it in.

I will say though that I was not aware I myself as the petitioner had to fill out an I-864 despite the fact that I didn't have any money and my aunt was going to be the only sponsor. They never gave me an RFE for that.

But when I got to the interview, completely unaware that I was missing a form, they told me then that they needed an Affidavit of Support from me and asked if I had it with me. So at least that lets us know you have a chance to give them extra forms at the interview if they were not in your initial packet.

In my case, I obviously didn't have the form on me. So they actually handed me the form at the interview and let me fill it out there and the officer acted as my notary, and we were approved that day.

So basically, I wouldn't worry. Wait to see if you get an RFE. If you don't, just bring along the form to your interview. And remember that the petitioner must have one, as well as anyone else who may be sponsoring you or your spouse.

If you haven't got an RFE - Don't worry about it. The interviewing officer yesterday changed a couple things on my wife's I485 and had her sign it again (he changed the A # - we had the wrong one and something else that I can't remember now.) So, I asume they can do the same with the I864 at the same time. Good Luck
