190 days and they ask for an RFE.

Timeline

I have a fiance. We are expecting a child and this whole process is killing me.

It is likely that my child will not be born in America.

For July and August I have been trying to get the attention of my sentators and congressmen. They made inquiries and Requests for Expedition, but they were getting snowballed as well.

Yesterday, I would not stop calling them untill they found my file. The inital customer service rep was very professional, the second could not operate a computer, and the third was again very helpful. It had been misplaced (in transit) for several months. I recieved all my recipts for NOA1 and the MBRA RFE, but still they lost it. Now my divorce decree is missing. I think someone took it. This is my current nightmare.

Do you have any suggestions?

Dec. 31, 2006 - OUR WEDDING!!! Ringing in a New Year as husband & wife!

Jan 8, 2007 - applied for SSN

Jan 15, 2007 - recieved SSN

Feb 6, 2007 - checks cashed for AOS/EAD/AP - YAY!

Feb 8, 2007 - NOA1 on AOS/EAD/AP

Feb 14, 07 - touched EAD/AP

March 8, 07 - Biometrics appt in NOLA

April 17, 07 - AP approved

April 19, 07 - EAD approved

Wow! World Class incompetence! At this point, I would say it's damage controll. They found your file, now mail them the divorce decree again, and maybe you'll have your approval in two weeks??

You would think that one of these customer service reps would take pity and give out his personal email address to you so you had a point of contact.

Man!! I feel your pain!! #######!! :angry: All you can do is comply with what they ask. They are sending you another RFE correct? you have to wait for the RFE. I would write a heart felt letter (as a supplement form to the petition) to go along with your RFE. Explain everything that has happened to you & request expedited service. I don't know if theres some kind of official form for expedited service but send that too if there is. I would keep riding your congress peeps!! and pray!!! good luck to you :thumbs:

I don't know if the letter will help or not. I can tell you that it's a person with feelings who will be reviewing the RFE and adjudicating the loan. It doesnt' hurt to pull at those feelings!!!!

FYI make sure your fiancee has a copy of the letter you wrote and can answer questions about it. Don't write anything that can be used against you!!

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

It is definitely time to get senators involved. You have been waiting too long!

You mailed your application in mid-February, I wonder why it took so long to get NOA1. We mailed ours a week later and had NOA1 before the IMBRA deadline.

I'm sorry to hear about your delays. I hope you get approved soon!

I would recommend getting your congressman involved. (i.e. representative, not senator). Historically they have proven much more responsive and because of volume of requests are able to look into your case much sooner than a senator's staff.

My personal experience was that it took 2 months for senators to even do anything whereas my congressman had a letter out to CSC director (faxed it direct) within a week, and two days after the letter was sent we were approved.

Others have had like experiences.

Here are the instructions for how to contact your senator or congressman. Hope you get some help.

Generally, emails and written letters to senators and congressman will generate a response, a few months later, thanking you for your support of their stance on immigration reform.

For more immediate assistance, follow these steps:

1) Find your senator or congressman’s website.

2) Go to the section for Constituent Services.

3) Download the privacy form.

4) Fill out all the relevant case information.

5) FAX it to their office.

6) Call to follow up. Find out the name of the specific person assigned to your case and get their direct phone number.

If your senator doesn’t have a privacy form on the website, call them directly.

Im a little confused by your post. Could you clear a few things up please.

Going by your timeline, you sent your I-129F on 15 Feb and received NOA1 on 21 March? Was that the NOA1 date or the received/receipt date on your NOA1? Was it transferred from another center? I ask because it is something that often causes confusion. On top of that IMBRA RFE's were being issued erroneously to those it didnt apply to.

You say you returned an RFE for IMBRA and now they are sending you a second RFE for your divorce decree??? That being said if they are issuing a second RFE, this wouldnt of been done without them having receipt of the IMBRA RFE, so it cant of been lost.

As for the divorce decree.....documents and evidence sometimes gets misplaced. Either that or the divorce decree submitted was lacking somehow. The fact they are issuing an RFE for missing/incomplete documents/evidence, means your file is being process. As with any RFE's of this nature, once what is asked for is returned to the service center, an approval is not too far off. Unless of course one is then held up in name/security checks.

One should be wary when speaking to operators at the NCSC as it is not known a the misinformation line for no reason.
