Hi All,

Current situation:

Me and my wife are Indian citizen we are here in US since January 2010 and we hold L1/L2 visa valid till Dec 2012. Now that my wife is pregnant with 4 months, she wants to visit her parents in India for couple of months. So after 2 months from now, she would return back to US.

Question

I want to know if my wife being pregnant with 6 months at the time of returning back to US might face any issues at

1) Immigration checkpoint at the time of entering US OR

2) At the time of exit from India?

Does any one know if any one faced this issue in the given situation? Can immigration officer object and deny my wife entering US / exiting India?

Please advise.

Check with the doctor if she is allowed to fly at 6 months. Not sure if its the case with everyone but a lot of people I know were not allowed to fly at 6 months pregnant due to the posiblity of it causing early labor.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

This may help you a little about what type of evidence or proof to carry with you to help regain entry to the USA.

Also check the FAQ from the New Delhi Indira Gandhi airport regarding pregnant women

It only mentions domestic flights - but the response to pregnancy on that website promotes a need to dive deeper into your situation.

I would suggest you do more investigation and contact airport personnel directly at the Indian airport and follow up with research about how your situation might appear to the CBP. I think it should be possible, but of course you should check.

Thanks for your reply. The link was helpful and I will make sure to carry the proof of Medicare and letter from Gynec about flying. So, I believe there is still a risk of my wife would be denied from entering US. Is that correct?

The main issue is I don't want her to stuck in India and Immigration authorities stopping her to enter US again just because they think she is coming to US to have our baby to earn US citizen ship. And if they stop my wife to enter again even her having valid visa that's the big trouble for us.

What the plan I was thinking that she can leave for India in a week and she will stay there for 2 months and I can reach India for 2 weeks by mid of October and we both will come together by end of October. So, if we both are coming together, will it create any immigration issue?

Please advise as we want to plan her travel at the earliest.

Since you have an urgent need, I'll direct you to another resource outside VJ. There is an immigration lawyer who runs a conference call every 2 weeks. You can post your question about pregnant travles on his forum and he will answer it on his conference call.
