Hello VS people, I got my interview date! :dance: 31st August @ 1pm, wish me luck!

Now, my fiancé has sent me the affidavit of support and supporting docs but since he's employed, he didn't provide me with his tax returns as nowhere in the form does it write we need to provide it. Same for the cheque stubs. Am I going to be in trouble?

His tax return for last year is bad as he only worked 5 months out of 12 (he spend 5 months with me in France) and with the bank statements and annual salary we're over poverty limit.

Can you help? What do you reckon?

Wow we have the same intervew date!

As far as I know you do have to provide at least one year tax return and paystubs this is what the embassy told me to bring for affidavit of support

Evidence Of Support: Evidence of financial support comes from the Petitioner. Usually, the petitioner completes the I-134 (http://arpsdir.a.state.gov/eform/forms/pdf/i0134.pdf) Affidavit of Support, with a job letter stating how long he/she has had his/her job and how much money he/she makes annually (W-2 forms and 1040).

Of course we are from different countries but as far as I know these requirements are pretty much the same worldwide

The Form 1040, U.S. Individual Income Tax Return, is the starting form for personal (individual) Federal income tax returns filed with the Internal Revenue Service (IRS) in the United States

Form W-2, Wage and Tax Statement, is used in the United States income tax system as an information return to report wages paid to employees and the taxes withheld from them.

Check with the embassy as well as any pre interview information sent to learn about the CO's expectation. Also check in the regional forum to learn from other VJ'ers going through the same embassy/consulate.

What is evaluated is current and continuing income. A great way to prove current income is with recent paystubs and a letter from the sponsor's employer stating position, length of employment, and current salary/pay rate.

Also, this prep will come in handy at Adjustment of Status time where the I-864 affidavit of support is submitted. This is a far more binding contract between sponsor and the US government.
