On the interview date request for a chance- my fiance did request it only be changed if it was possible while I was there. He knew the conference was coming up and didn't want things pushed too far away.

Well, I'm listed as a dependent on my parent's taxes, and that's more of a relief for them than it would be for me, so I've never filed (and never been above the requirement or anywhere near it.) I've also been a student, so not had much income.

My fiance had questioned a former co-worker who moved here to marry a US citizen and he'd said he'd had a similar situation at the time with his fiancee and passed fine, so he turned in the I-184 since my parents' has been available. However, I'm getting worried since I don't know how much things may have changed since then.

J is a student too....so will be interesting to see how you go...I can let you know how we go too.

I called my fiance right when I read your post last night and we are both so bummed. He is still going to mail back his letter today saying he is ready for his interview. We were really hoping for an Oct. 6 wedding...doesn't seem like that is going to happen now. Plus, his Mom already booked her plane tickets (against our advice) to come over for a wedding. We tried to make it clear when we told everyone we were going to try for Oct. 6 but nothing was guaranteed as of yet. Maybe she didn't understand, I don't know. It all stinks! We've already canceled 1 wedding because of our lawyer and USCIS screwing up...so then was granted a Congressional Inquiry to get us this far. I guess I should at least be grateful for that. But why do I feel so sad today...just tired of things going wrong.

Awe I think you should just send the letter in. Because you have congressional Inquiry, they will most likely pass you through faster and before APEC. I would just get that letter back to them immediately and see what happens. Don't let it get you down yet hun because they may surprise ya ;)

Timeline

Valky - I recommend that you get the employment letter from your employer and a years worth of your bank statements as well as your employee pay stubs for the last year. If your parents are co-sponsors, then they will have to get all of this as well, but this will prove that you are holding down a job. You will not need to actually have proof of taxes filed to prove you have paid taxes because although you are the primary sponsor, your co-sponsor will show that he or she has claimed you on their taxes. You should also write a letter of explaination regarding that and make special note of who has claimed you as a dependant in that letter.

The IRS cannot provide you with anything substantial, but the social security office can. I would call them and ask for the breakdown of years worked (They normally send you this in the mail every year anyway) because you are paying into social security and that will prove that you are indeed paying taxes. You can also submit your yearly tax documents from your W2 to prove that you have paid taxes and that should suffice. You do not have to actually file taxes to prove that you paid taxes. I hope this helps some.

Thank you VERY much, rings! I do have a couple assets (Roth IRA, savings), a steady job, my W-2 from last year, social security report (I had to order it for a class... and I'm glad I have it ^^) and I've got a checking account deposit summary as well. I'll call my dad's office manager and ask if he can get a pay-stub for him, but I know he also has records here at the house of his employment and checking account deposit statements.

I feel MUCH better now. Interview wasn't able to be changed, but we sorted things out anyway. I think the waiting is just bringing out my doom and gloom/compulsive worry side, lol.

Congrats on the Green Card! That's fantastic! Long road and it's good you've finally got that ^^

David - Holy heck am I glad to see you! How have you been? Awe I remember when your wife just got her visa. I am so glad to see that things are going ok. I know that the work situation sucks, but it means that you will have more quality time I think.. Ok maybe I am convincing myself of that :P Anyway i hope you two lovebirds are doing ok!

Nice to see you pop back in! Glad your wife is up and running although the 2 week vacation-shock sucks. What line of work is she doing? Most companies give about 3 weeks nowadays unless it's 2 weeks of normal vacation coupled with a week or so of "sick days".

Depending on the job she might luck out and eventually switch to a European company with US offices. My sister is switching jobs to one that is European owned. All of a sudden she gets 6 weeks vacation! What the hell?? I want a deal like that. :hehe:

Anyway, glad you two are doing well otherwise! Don't be a stranger. I plan on visiting here even after the wifey FINALLY gets her visa and moves over. I'd love to pay it forward and help folks starting their journey. I've learned so much just hanging out here.

She's working for Navy Federal Credit Union. If I ever get stationed overseas somewhere... there's always a Navy Fed Credit Union so while I'm in, she'll just work for them in the meantime...

I just now read a post where the American Embassy in London denied someone of their visa because they did not have a copy of their husband's 2006 tax returns. Now, perhaps their situation is different because they are already married, I don't know.

The instructions on the I-134 states that the tax returns are needed if you are self-employed, but I do read a lot of posts of the sponsor sending over their tax returns. Can anyone clear this up for me....are they really needed? I am not self employed.

Kym, I saw that post too. He needs to file the I-864 or I-864EZ with his 2006 return. I am not sure about the I-134 but I bet it has pretty similar requirements.

The issue is that the sponsor (husband or fiance/e) is required to file the most recent tax return (or have a really good reason for not doing it). I saw he asked for an extension but the reality is he can file married filing separate. I filed jointly and our ITIN is still pending (damn IRS backlog and USPS mail screwups on tax day argh). Anyway, I thought about it and don't see that as an issue because my salary is still my salary regarding the numbers game and the 125% poverty line. I see the issue in that he technically can't provide sufficient support until he files the 2006 return (jointly or separate). I have filed (and have money owed to me) and that is what really matters. I am hoping though in my case that the filed return is processed by the time our NVC process is completed and the wifey goes in for the consulate interview.

So to answer your question, I would suggest sending a copy of your 2006 tax return and W-2, 1099, etc in with the I-134. It doesn't hurt. Then be prepared to send another copy with the original W-2 etc, to your foreign spouse / fiancee for the interview as backup. That could possibly save you heartache like that other poor couple. I do see that it's an easy issue for them to resolve so that's a good thing. They were denied on a technicality which can be addressed.

Katz, there shouldn't be any corrolation at all between waiting times for interviews and your original petition :) I hope it goes through quickly for you!

I'm more worried about stuff being mixed up or lost because of this APEC thing. But eh, I'm trying not to worry too much. :P

hee hee I know what you're feeling. I got very anxious about things like that. I don't think you need to worry about APEC. I think that APEC will be over by the time your things are sent to the consulate, and it will be business as usual.

Hey, it might even be quicker since so many people rushed to get their interviews before APEC? *wishful thinking*

Don't worry too much, just read everything you can on this website, make sure your petition has everything included so you make it easy for them. It will be just fine. Despite what you might read on VJ, even though the visa process is very tricky the people dealing with the applications are a well oiled machine and mostly everything goes through just fine without mistakes. It will be just fine!
