gday good to see some other aussies about im tryin to get info on having my 10 yr ban waived

my interview in sydney is wed 11/7/07 I know about the forms 601 and 212 and have them prepared to take with me...i guess my question is on the success rate of returning after being deported my wife and i have been married almost 5 yrs our home was jacksonville Fl we first applied for 485 back in 2002 they denied our app and deported me as an overstay in dec 06 reckon i really wanna know what are my chances for gettin the ban lifted and how long till i can come home...any help would be appreciated.

Not many people are approved hardship so you will have to make a very convincing letter. I have read up on this and I have seen only two cases on this entire forum that were actually approved and one of those was due to medical reasons and the other was due to religous belief from a country that practices. It is hard to tell, but I would recommend a lawyer if you can get one. Hardship cases really depend on what happened and why you overstayed or broke the law. :( Wish I was more help, but some additional information would help a ton in being able to possibly help you.

thanks for the response..we have included copies of letters from my wifes oncologist and other doctors we have also included a copy of a letter from congressman ander crenshaw to the head of consul in bangkok requesting expedited processing..i have no criminal convictions i had entered the US on visa waiver in 2002 and adjusted status as spouse of USC they falsely claim my wife withdrew support and as such denied my petition.. they then ruled me as inadmissableand subject to removal.we never even saw a judge 6 weeks in detention centre in miami and escorted all the way back to sydney airport.we have been fighting ever since

I have been trying to 'catch up' on this aussie thread...even from a couple of weeks back is a long read!

Looks like most of you are moving right along....approved, interview, waiting to come to the USA....congrats to you all.

My fiance and me have been going through this god awful process for the last year now and I think we are so close now....Finally!!! I am getting so excited! We have got to see one another 1 time in the last year!

He has rec'd his packet 3, I mailed all my paperwork (affidavit of support, etc) 1 week and 2 days ago...so hopefully he will get that anyday now. He has applied for his police certificate, he has his medical scheduled for tomorrow and is supposed to pick up his court records tomorrow as well. I think he is about set to let them know he is ready for his interview!!! (Can't wait)

I do have a couple of questions....

How long does the police certificate normally take? He applied about a week ago - should he call the police station to check on it or give it more time?

When do you think they will stop scheduling interviews until after this APEC thing? I am hoping that his interview will be sometime in the beginning part of August....if he mails back his packet next week, how realistic do you think that is?

Do you recommend that he waits until everything is in hand before sending back paperwork stating that he is ready for his interview, or how risky would it be to go on and send it in before having everything in hand?

I know these questions have probably been asked before....I just recently (finally) found the Aussie thread on vj. We have ran into so many complications throughout this process....I just hope hope hope everything from here until the end goes perfectly....and eventhough I've tried to be patient, I just want to be done with this so we can be together!

I haven't been on here for "minute" (for a while). I hope all the newbies are finding this to be helpful.

Right now... my wife has finally made her way into the working class and is feeling more home sick than ever... after realizing that Americans work their asses off for 1 year and only get two weeks off for it. So enjoy your 1 month annual leave while you've still got it. It made her realize why middle class Americans can't go on these nice long European holidays...

Anyway, I found a website for her to vent with other Aussies. Mates Up Over Anyway, she only moved over here for me.

Hope everyone one is doing good... for those who know me =)

04 January 2004 : Met Stephanie in Las Vegas.

27 December 2006 : Received RFE in the mail, returned RFE same day.

24 January 2007 : New Legislation preventing approvals of I-130s at Consulate.

30 January 2007 : Final Visa Interview in Sydney.

22 February 2007: Sydney called for my wife to send her passport to issue the visa.

04 March 2007: Stephanie flies back to Australia to post her passport.

14 March 2007: Stephanie Recieves passport and visa.

18 March 2007: Stephanie is in Florida. Journey is over.

30 March 2007: Stephanie gets Social Security Card.

02 April 2007: Stephanie gets Green Card.

hi kym... i'm waiting for the consulate to send me a letter for a interview time and day....

police certificate took them 2 weeks exactly, if your fiance has his medical with Dr Waks for example - that doctor sends everything to the consulate directly so you dont have to worry about it....

i do suggest he wait till he has everything then he can send in the form saying his ready and just wait......

Apec - i know that they close for one week..... thats all i know sorry!!

I am with her on this; I was deeply dismayed when I found that out! :crying:

My work here also has good work/life balance structure that it prides itself; we work 9hr days and finish 12pm on Friday.. another thing I will miss. :( Funny thing is, when I said to J that we're supposed to work to live not live to work he'd never heard of that concept before... :wacko:

Is there a way to lobby the government.....??? If not, when he gets into congress one day we shall have to bring it up on the agenda... :yes:

Tonyr7 - I am so sorry about your loss. I recommend that you detail the entire story out in your submission of your hardship letter. You will not only need the back up documentation, but also any and all legal documents pertaining to the claim against you in a court of the law. You should obtain a copy of the police report from the jurisdiction in which your case took place, all of the supporting documentation regard to your subject of removal. Travel documents pertaining to the removal and termination of your pending adjustment of status.

I also recommend that you obtain any documents with regard to proving that your wife did not withdraw support in the given case. Now I am not sure what you mean specifically about the withdraw of support and if you mean that the USCIS has admitted to actually receiving a letter from your wife of cancellation (If this is case, I would request proof of that submission along with a detailed letter from the USCIS indicating the date stamp of receipt on the actual letter of cancellation received) or if she applied for government assistance which would ultimately mean that she would have had to show some form of proof to the government that she was below poverty guidelines in order to achieve such assistance. If this is the case and she indeed did this, then they will know what is going on and that will be hard to prove. However if this is a case of mistaken cancellation on behalf of the USCIS due to unauthorized proof, then they should be able to provide you with a detailed letter explaining that proof. There is no better weapon that you can obtain to fight for your case with the USCIS than to have a letter from the USCIS themselves.

Sharyna - Don’t you worry, that letter will come and it will be fast if it was anything like ours. I did bother the Sydney consulate with e-mails and calls though. They probably pushed us through because I was so annoying lol.

Vylex - OMG you are so right! I remember when we just barely sent our petitions and even though it seems so long ago, I know that it was just 5-6 months in total. It is definitely a journey though and not many people understand how painful and hard that it really it. Thank you so much for your support throughout this!

Kim - he should call and keep bugging the station to see if the report is ready and it will take at least a week for the medical results minimum. You want to be sure to have everything because it was a close call with Loke and I. He barely got his medical results a couple of days before his flight! I think that it is better to be safe than sorry and you do not want to reschedule because that never looks good. If you get packet 3 completed, you may be able to beat APEC, but i would not worry too much about it because they will still be scheduling interviews refraining from scheduling during APEC either way. Welcome to the Land Down Under by the way!

David - Holy heck am I glad to see you! How have you been? Awe I remember when your wife just got her visa. I am so glad to see that things are going ok. I know that the work situation sucks, but it means that you will have more quality time I think.. Ok maybe I am convincing myself of that :P Anyway i hope you two lovebirds are doing ok!

I am insanely jealous right now o.o Why can't that be me at Sydney? blagh :P I know my time will come soon enough, but... argh! /jealous /pine /jealous :P

Congratulations all the same :)

I remember that feeling, how hard it is to be happy for other people's success while you are still waiting and hoping to hear something on your own case. It was the same for us when we were seeing others who had filed around the same time as us getting approvals and interviews and we looked every day for a touch. Haha Rings even posted a thread on the main K3 board about being last in the slow line and we took to cursing Arthur the slow immigration officer (we have no idea who handled our case, it was just easier to make up a name and it gave us a bit of houmorous satisfaction to be able to yell at the fictional Arthur).

Thank you to everyone who is with us through this journey - we still have a way to go but we will get there, just like some of you have, and some of you are and some of you will.

Tony - I am sorry for your situation, it sounds like you have been treated really harshly and I hope you manage to get some resolution for your case. It's beyond my experience to know how to advise you but getting as much documentation as you can to support your case is always a good idea. I hope they don't keep you apart from your love for too long.

Kym - I sent my letter asking for an interview before I had everything in my hand and we got away with it but they did schedule my interview really quickly and I picked up my medical results only 6 days before my interview. I knew when I sent the letter that the documents I needed were not far from reaching me but I guess its a gamble you have to weigh up for yourself.

Sharyna - From what I can tell they are trying to rush things through before the APEC summit which will slow their services through late July and August and close the consulate completey between the last week of August and the first week of September. So you should get your interview soon, they have allocated extra interview appointments before they reduce their services.

Everyone else - congratulations or good luck or thanks for your support, whichever is applicable and WOHOOO! Now I just need to sit out 4th of July and go get my visa tomorrow afternoon.

Nice to see you pop back in! Glad your wife is up and running although the 2 week vacation-shock sucks. What line of work is she doing? Most companies give about 3 weeks nowadays unless it's 2 weeks of normal vacation coupled with a week or so of "sick days".

Depending on the job she might luck out and eventually switch to a European company with US offices. My sister is switching jobs to one that is European owned. All of a sudden she gets 6 weeks vacation! What the hell?? I want a deal like that. :hehe:

Anyway, glad you two are doing well otherwise! Don't be a stranger. I plan on visiting here even after the wifey FINALLY gets her visa and moves over. I'd love to pay it forward and help folks starting their journey. I've learned so much just hanging out here.
