Hi! I'm new to this site and just had a few questions...

I currently hold a TN visa and am planning to marry a U.S citizen in the U.S. After we get married I plan on filing an adjustment of status in order to get my green card. My question is after I have filed all of the paperwork can I quit my job or do I have to be employed at my current job until my adjustment of status interview? During the interview will they ask me about my current job and ask for proof that I am currently employed? What are the implications if I have quit my job before the interview?

Also, does anyone know if the immigration officers independently do their own research or do they just go by the documentation that you provide them with?

Any information would be very helpful!

I'm not an attorney obviously, but having gone through the same process, here is my take. I chose to continue working on the Tn until my EAD arrived, at which time the employer updated the I9 (Employment Eligibility Verification form) to reflect the change.

If you are filing AOS based on marriage to a USC, such as in the guide here on this site (link below), then it does not matter whether or not you continue working for the Tn sponsor or not. You may continue to work on your Tn for the duration of the validity. Your Tn remains valid until the expiration date, or until one of the following occurs:

-your employment ends

-you begin employment using your EAD

-your AOS is adjudicated

So if you quit, you will lose your Tn, and not be able to work again until you get the EAD. When your AOS is adjudicated you will hopefully get the green card. If not you will have to leave. The Tn status is irrelevant at that point.

Either way, you will need an AP to reenter the USA. Once you file the AOS, you should not leave and then try to use your Tn to reenter the US.
