Can We Refile K-1 ??

You can certainly re-file, the US government is always happy to take someone's money.

What should be asked is what have you done to overcome the original return of the petition? Without addressing this issue why do you thing the case will be treated any differently the second time it is filed? Morocco is a very difficult consulate to obtain a visa from and you should address the original problem prior to filing another petition.

did they tell u that it expired or r u going by the original NOA2 that u recieved? Because Casa has been extending to expiration dates on the NOA2s that get returned to give CSC time to review them. I this is the case, they could be reviewing it. The problem is, that can take a lot of time to happen. As for refiling if you don't have a letter stating it has expired...I'm not sure. I know I've heard of others refiling K1s to "push" the other through quicker....not sure if this was after an expiration or not. I'm more suprised on how quickly your case got back to the US. But as others have mentioned...refiling won't do you any good unless you know the original reason for the 1st denial, because if you don't fix that they will just redeny you. That why there was the suggestion for the CR1....CR1s are more difficult to fully deny, because you are legally bonded & the expiration isn't so short. So before u decide to do anything I'd figure out your red flags & how u can fix them & go from there. Best of luck to u both!!

hey everyone

our k1 was back to uscis for review but nothign happned and it's expired a month ago can we refile or not ??

You can, but chances are it will be denied again. Our case was returned and we were told it would be extended an additional 4 months. We received a letter telling us our time had expired (original date, not extended date) then I received an email a few weeks later telling me we were denied and I letter would arrive within 15 days. Didn't receive the letter, called and was told it was an I-797 and they would resend. Contacted my lawyer and he said it more than likely can be stating the expiration, but knowing the changes that have been happening it is best to see what it says. Meanwhile, we have been told our best option is it marry.

IF you refile, be sure to cover the reason for the denial and anything else that will be an issue.

Do you know the reason for your denial? Have you been back to Morocco again since the interview?

I met my guy in October 08 and in October 09 I went to meet my life for the first time face 2 face.

Was there 11 days and had to come back, due to work. Filed 1-09 and got approved from usics in Mar-09. Interview in Casablanca May, sent back 221G. Today 9/4/2010 got letter from usics that our petiton had expired. But that we could refile. Due to my job, Im only allowed 2 weeks vacation to return, which is not enough time to marry my life there.

MY Habibi was the last in line that day and this woman only spoke to him a very very short time before handing him the return letter with a smile on her face. she never looked at one piece of proof he took in. even the letter from my son staing he accepted my fiance and agreed to be his best man when he gets here. Nothing they looked at. When we were returned, I got a e mail from casa stating his visa was not denied but being return for review. I have been to my senators and trying everyway to find out the reason for our return and can not find anything out. Even in the expired letter today, It says nothing about why we were returned. How can we find this information out before we refile again? any information is needed. thank you, khadija a

You can file a second K1 without waiting for the first to be expired . I did that and was successful in the filing

did they approve your refile ???

and how did you know the reason for them to deny or sent it back ( all i can get using help of sentor is a letter said the egyption fiancee cant prove a relationship , and thats why they send the case to review in uscis )

did u know any other way to get more detailed info about your case

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

The first denial was obvious, they demanded that he give them details of my classified work and of course he said he doesn't know, and they said no visa. Second time through I was outside the embassy with a large package of forms to justify their request access to this type of information ( for them to fill out and explain) , so they didn't push that path and we got the visa.

Do you know what areas your fiance had trouble with ? Was your initial package weak ?

You can file a freedom of information request but those can take some times. We front loaded the second petition ( over 7 pounds ) and had almost the same amount of added stuff to take to the embassy.

This will not be over quickly. You will not enjoy this.

did the freedom of info is what we do by sentor inquirey , or something elese , and if it something elese did they give you a detiled answer or just like usall the fiancee cant prove a bonfida relationship
