Alright, so my fiance is here and we'll be getting married soon. We plan on filing AOS very quickly after the wedding (he's a bit of a workaholic, and would like to start working ASAP), so I was just wondering about a certain aspect of the affidavit of support.

During the K1 process, we used my grandfather as a co-sponsor (since I'm a full-time student) and plan to do the same for the AOS process. I understand all that needs to go with it, but I was curious as to whether I needed to get updated letters from his employer, or if I could just use the ones that we used for the K1 process since that letter is only a few months old?

Please have a read of the AOS thread mentioned in my signature, it will give you the required documents list.

You do not require letters from an employer when filing the I-864. You can elect to send them if the income mentioned in his tax returns doesn't meet the income threshold, but it's not required and I wouldn't waste your time with them if you don't have to.

If you wanted to send the letters you should get new ones.

The reason I'm electing to send the letter, and subsequently posted my question, is because not all of his "income" comes from his employment - he's got SSI, pensions, etc. His job is only part time because he's retired. I'd rather 'waste my time with them' then not have them.

The reason I'm electing to send the letter, and subsequently posted my question, is because not all of his "income" comes from his employment - he's got SSI, pensions, etc. His job is only part time because he's retired. You didn't say it but your response indicated you took offence to some things I said so..

1. Actually that's my standard line about the thread. Just today I realised I didn't mention divorce documents in my AOS thread and actually for some people those are "required". Also, I bolded the word required because sometimes I forget to address issues such as your letter from employer not being required. It wasn't intended how I now realise it looks.

This is the only reference to knowing the required docs.. and honestly I'm still not sure whether you meant you knew what AOS docs you need, or what I-864 docs you need. In either event I usually direct people to my thread... I'm not saying you are one of them, but you'd be surprised how many people don't realise an I-693 might be needed, or think an I-130 is needed (among other docs) so it's just a standard line, again not intended to sound (or "read" rather) how it looks.

3. You mentioned the letters from employer and they're not required.. so that in conjunction with 2 led me to believe didn't know the full list. Again not intended to be insulting just how it read.

Still, my husband at the time of filing AOS, received income from the VA (disability) as well as other schooling payments (not school loans, from the VA it's different) as well as working and studying full-time. So I know all about not all income coming from one source. As his tax returns were above the 125% we simply sent the 2009, 2008 and 2007 tax returns. The 2009 was all that was required, but we sent the others anyway. We didn't waste time with employer letters, or letters from the VA this time around (had to for the I-134) and it was much simpler. Though as I said, if you wanna do it, have at it, you just don't HAVE to :)

As for Iowans, yep. Happy to be out of texas!! That's where hubby was when I arrived. Hot hot hot and scary sometimes too (we lived in Houston :S)

I don't think I really took offense to anything you said, per se. I have been so hectically helping my family with all this darned flooding going on in Des Moines, and I'm sure you can guess what happens when it's hot and we're all exhausted -- tempers flare. So I apologize if I came across .. well.. b!tchy. I didn't mean to. :/

What I know of the AOS process and the documents required is what you put in that post. Like I said, I've had it bookmarked for months now because it's, single-handedly, the most useful guide I've found thus far. So if it says it's required on there, then I add it. If it says it's optional, well then I will probably add it for safety's sake, lol. Thank you for writing it. :)
