Hello everybody (Im sorry because of may English).

This my story! I went to USA in summer '06 with a J1 visa. I met there who is now my husband. I came back to my country (Dominican Republic) 'cause My visa expired. My husband started the process for a k1 visa, but some people (incluiding inmigration attorney)told us that this process was taking about 1-2 years, so we decided to get married 10/20/2007. We never stop the k1 visa process, so 5 months after marriage the packaqe with the interview got here :unsure:. But in our status we couldn't go to interview. We sent a notification to the local consulate stating that we wont go to the interview, so they will cancel that petition (we received notification later from USCIS about this cancelation). By the way my husband lives here with me since we get married.

After this my husband mailed the I130(02/28/2008), and was aproved only 1 year ago(09/15/2007) after many trips to US and appointments in the orlando, fl field office.

Our daughter was born in January 2010 and in April 2010 we decided to sign with an attorney cause this is not working. He finally could find out why our case never got the NVC. Instead of send the case to NVC after aproval, the USCIS sent the file to their national record center. And now we are fighting for this case reach the NVC, but the interesting part of this is that USCIS never told us they haved the file in NRC. Then our lawyer informed us the situation and when we call and ask they recognized that they have it at NRC.

We already sent an email to the congressman but we dont have any answer yet. I hope our lawyer is working well (sometimes I have the doubt). Probably we have part of the fault but,I dont understand why this is happening, the receipt numbers for the k1 visa and the I130 are clearly different, so I dont understand their confusion and my lawyer either.

Is anyone happening for this situation or similar? Thanks for taking the time to read my post :help:

husband still with you, in dominican republic?

if so, suggest instead - that HE file an I-130 at the US Embassy, on Monday.

Also, any 'child of us citizen' issues - hey ! file a Consulate Record of Birth Abroad at US Embassy, along with US Passport application, soonish.

these 'other issues' that you have -

can be 'tossed out' by Consular Officials AFTER you have submitted the DS-230, Visa Application, into the Embassy, provided that you two include a 'letter of explanation' about the 2 prior petition attempts.

Tossing out, IMO, is a good thing, as the ConOffs will review the prior petitions, and approve the new petition and Visa Application (I-130 and DS-230) there in the DR.
