Hi there,

We were denied the K1 at the time of the interview, and our I-129F was returned back to VSC for review and possible revokation on the grounds of inadmissibility. We have never been given an official denial, so we have no clear idea what was the actual 'ground'.

A few months later, after consulting with the attorney, we got married and filed I-130 for CR1 while our returned I-129F was still with USCIS. Our new petition stayed longger than 5 months with CSC, and we called their office to report about the case outside the normal processing time (5 months + a few days). A couple of weeks that our new petition got a 'touch' and USCIS website, and a week later we got an official paper letter informing us that our first petition was closed due to the term expiration (it toook one year from the returning time!). And in another week after that out I-130 was approved at CSC, and it is currently at NVC.

So, at USCIS stage we have never been sent any RFE for our new petition, or any NOID which we, actually, expected! Well, for now we are just trying to be prepaperd for any possible questions at the interview.

As you see, that's a real story of two petitions from the same petitioner pending at the USCIS at the same time (only one was approved at a time), one of which got closed before another's approval.

Ok, it sounds like your I-130 forced them to make a decision on the returned I-129F, and their decision was not to make any decision at all and just let it expire. It would be good to know if this is also standard procedure when you file a new I-129F.

I doubt this will apply to you because Kiev is not known to be a particularly difficult consulate, but I've also heard stories about the consulate in HCMC sitting on a new approved petition because they were waiting for a formal decision from USCIS on the returned petition, and USCIS was never going to make a formal decision since they'd already decided to close it because it had expired. I've never seen a VJ member post that this had actually happened to them, but according to M.E. it does happen.

05/01/2013 - Removal of Conditions - APPROVED!

My 3rd trip will be in September 2010.. Our wedding is plan for 9/26, I'm planning to obtain that marriage certificate during 2 week I'm there.. Will that be enough? or I have to come back again in 4th trip after wedding?

Get your "CONG HAM DOC THAN" single status. 2 weeks isn't enough to signs your paper.

Like other mention if you have the right connections 2 weeks can be done.

I was there only 3 weeks for our wedding, and they schedule us week #4 to sign our paperwork. I requested to pick up early, COST me $1000. So, I have to begged my boss to let me had 4 weeks vacation, and I finally got it done without any $$$$$.

If you decide to stay there for 2 weeks, hopefully you can DEAL with them UNDER $300.

06-18-2009 : US Entry!!! Yeah, my wife finally here.

06-29-2009 : Received SSN from snail mail

07-20-2009 : Green card received by mail

09-15-2009 : Writting test from DVM.

11-03-2009 : Driving Test.

01-20-2010 : Working.

04-20-2011 : Submit I751

04-26-2011 : Received I-797 NOA with Receipt Number

05-11-2011 : Received ASC Appointment Notice

06-03-2011 : Biometrics Apts @ 11:00 AM

10-11-2011 : Submit more evidence.

Very sad to hear this and my prayers go to you both. I personally think it is bogus to put so much emphasis on that engagement party but they do it seems. I have heard of a pink without one before but it is rare. I wish they would be consistent. Maybe it has to do of who is handling the visa and interview.

The others told you how long it will take, therefore, if you want to do in one trip, you should have your wife to give some money to the authorities in So Tu Phap to arrange for your appropriate time within 2 weeks. Money may break the rules in Vietnam. I knew that to bribe them is not good at all, but you should try to make your trip efficiently.

We had to bribe them so they wouldn't make it more difficult. We had already planned for 45 days, we just didn't want it to turn into 60+ days. Instead of money, we did a gift basket of soaps, shampoo, medicated oil, cigs and body sprays.

if you want your certificate in 2 week you have to pay $500 or $1000
