My wife and I are ready to file our joint i751. Her conditional GC expires 10/23/2010, and currently shows her MAIDEN name, as does her passport. All other legal docs show her name in the following format: First Middle Maiden Married. We have completed the i751 as follows: Family/last name - new married name; Full middle name - middle AND MAIDEN. With the i751 we are submitting marriage certificate, Driver license, SS card, which all show the format FIRST MIDDLE MAIDEN MARRIED. How should we file the i751 LAST NAME??? Married or Maiden? Is it okay to put MIDDLE & MAIDEN together in the Full Maiden Name field of the application??? I called USCIS with this "general question" and they said to put down whatever her current legal name... BUT THAT's MY QUESTION!!! WHICH IS IT???

Is her maiden name part of her middle name or last name? If it's part of her middle name, then just add the maiden name to the middle name box and if it's part of her last name, add it to the last name box together with her married name. And under the "Other name used", just put her maiden name there.

I did a legal name change and submitted the I-751 with my new legal name. Explained the situation on the cover letter and enclosed the doc for them to review.

My passport is still showing my maiden name and I travel with the court document all the time.

05/27/08- NVC received our application and case number assigned

06/02/08- DS-3032 sent & AOS Bill Generated

06/05/08- Paid AOS Bill online

06/16/08- DS-3032 email accepted by NVC

08/28/08- Case completed!

10/21/08- Interview date (Rescheduled by US Embassy- Original date 10/28)-PASSED!!!

10/22/08- Visa in hand!

10/31/08- POE- Seattle, WA

11/12/08- Received SSN in mail!

11/20/08- Got my WA driving license!

I-751

08/03/10- I-751 sent

08/09/10- NOA

08/24/10- Biometrics

10/28/10- Case approved

Yes, we added the maiden name to the middle name field. Her last name is Brooks, so we didn't want it to be filed under her maiden name or use a dual/hyphenated last name so we stuck the maiden name in with her middle name. Do you think that'll fly? Or should we change it back to just maiden, like the current GC is? Or change to just married name, like we file taxes? Or just leave it like it is? Thanks a bunch! We're trying to file by Monday and freaking out

You can filed it with First Name, Middle-Maiden Name, Married Name like all her other docs. I did a lot of research on this because we were wondering the same too. As long as you have documentation to support the new name, you will be fine. :D

I really appreciate your input. There's virtually no instructions on this issue from USCIS. Reading the N-400 really had me contemplating filing it just as it is currently and then changing when applying for N-400, but we are just gonna send it in.

That is your other option too. :) Since we are not filing for N-400, this will be the option for us to have the GC with my new legal name without having to pay extra!

But since you already have other docs in her new name, you will be fine. Just explained it on the cover letter and provide the marriage certificate.

Right. Her current GC reads: FIRST / MIDDLE / MAIDEN

We are sending application as: FIRST / MIDDLE MAIDEN / MARRIED

We are including a brief explanation sheet along with Marriage certificate, Driver License, and Social Security Card. The DL and SSC read FIRST / MIDDLE MAIDEN / MARRIED. We file taxes, and generally go by, as simply FIRST / MIDDLE / MARRIED.

I hope this works out OK. I wish they could update the i751 to instruct this specifically, but I guess that's part of the upcoming reform???
