Annulment by Pressumptive Death

Timeline

Who among the people here have already started a K3 or K1 visa using an Annulment by Pressumptive Death? How does the interview go about and what did they ask of you to bring aside from the COurt Decree, Finality of Judgement and Annotated MC? I really need to drop my I-130 but i want everything squared away before i proceed, please a little help from you guys will make me feel relaxed, im pregnant right now and i can't stop worrying.

06-07-19- Sent I-130

06-11-19- NOA1

02-19-20- "Initial Review, Transferred to another Visa Center"

03-11-20- APPROVED!!!

The US Embassy accepts presumptive death as evidence that a Filipino marriage has been terminated, but they are more suspicious of these now because more and more Filipinas are using presumptive death as a way to terminate their marriage even if the husband is still alive.

If you are absolutely certain that your husband does not turn up alive during background check by the embassy, there is no reason to be scared.

yes i do have everything and is authenticated by the DFA too, the problem is i have no idea of my ex's whereabouts,the last time i tried to talk to his family they didn't entertain me. My ex's mother in law's address is indicated on our Marriage certificate and the embassy might talk to them and finally tell the truth after years of hiding once they get to know that im moving on already. That will be so unfair on my part because in the first place i want everything squared away but they just won't cooperate.

Well then you shouldn't have any problem. I think what you should do is go to NSO and submit the annulment decree so they can dissolve your marriage to your ex. You should have happy trails in this journey. Good luck kaibigan.:thumbs:

Ceejay, I'm sorry I did not see the word "Annulment" by Presumptive Death. If your marriage has been annulled (by reason of presumptive death), then you should have no problems even if your ex shows up alive. The ones that had problems were those who only submitted a Declaration of Presumptive Death without annulment.
