Change of Address before sending in RIE

Hello everyone,

This is my first post even though I have been reading your posts for a while now.

My USC husband and I got married this past May when I was on OPT, and we filed for AOS on 7/12 a week before my OPT expired, following the directions and tips given in the guides and various posts here (thank you all so much !!!! ).

We got our i797c's shortly after filing, and got biometrics appointment about 3 weeks ago. Then 2 weeks ago we were sent an RIE (request for initial evidence) regarding form I-864. Basically the letter of employment my husband had sent in originally wasn't good enough for USCIS, and they wanted another one detailing hourly wages, duration of employment, formal working hours, etc... I should also mention that my husband just graduated from college and is starting grad school a week from now, so the letter he sent in originally was the offer letter from his school indicating his projected stipend. However, we were really stumped to get an RIE, because my father in law also sent an i-864 as a joint sponsor together with my AOS package; his income alone would have been more than enough to cover me and all his household members even in the case my husband had no income, but I have a feeling USCIS didn't even look at it.

Well anyway, we contacted my husband's grad school to request a new letter that satisfies USCIS' requirements, but we were informed that the person that can give it to us is on vacation and will come back on 8/18. My husband is moving to Cambridge, MA to start his work on 8/16, while I will have to stay in Phoenix for the biometrics on 8/25 and join my husband hopefully the next day.

All 3 applications ( i130, i485, i765) are being processed at the National Benefits Center according to the NOA's, but I am unsure if they have been transferred to a local office presiding over Phoenix. My question is, where do we send the RIE, Phoenix or Vermont, seeing that we will probably do that after I have moved to Cambridge? Also can I file an AR-11 before my actual move since I know where we'll be living already? In your experience, would a change of address (when taken care of properly) delay the AOS process significantly?

Did you send your husband's tax transcript or w2 and Federal tax return from last year? As to where to send the documents, I'm not sure. What I can tell you is you can change your address before you move (that's what I did). I changed my address while my AOS was pending before I moved (2 weeks before). Did not have any issues.

My husband did send the Federal Tax Return for 2009 which reported the income from when his father sold some stock in his name. He did not have a W2 to send because he was in school and not employed. This time around, USCIS asked for a more detailed letter from his grad school, and his form 1099, which we always had but did not send in because the instruction on the i864 didn't ask for it (plus the info on the 1099 was included in his Federal Tax Return anyway). Our guess was that USCIS didn't want to include his dad's sponsorship if they could avoid it because it's more paper work for them, even though we wish they did because my husband's income is still a projected number at this point.

I guess I will go ahead and file the change of address now. Thanks for replying!

06-18-2009 : US Entry!!! Yeah, my wife finally here.

06-29-2009 : Received SSN from snail mail

07-20-2009 : Green card received by mail

09-15-2009 : Writting test from DVM.

11-03-2009 : Driving Test.

01-20-2010 : Working.

04-20-2011 : Submit I751

04-26-2011 : Received I-797 NOA with Receipt Number

05-11-2011 : Received ASC Appointment Notice

06-03-2011 : Biometrics Apts @ 11:00 AM

10-11-2011 : Submit more evidence.
