I'm the petitioner (us citizen). I live in the Philippines with my wife. I would direct file but I'm on a tourist visa not permanent residency. Should I use my philippines address on my i-130 or use my US mailing addres? I'm guessing I should use my US address. Is it a problem if this is a postal box? I can use my parents address if not.

Also, I am confused about page 2. Page 1 says the petition is for my wife and we have the same married dates. On top of page 2 it wants yout list the husband wife and children of your relative. Do I need to list myself there again?? I don't want to leave it blank and get it kicked back if I'm supposed to fill that out for myself.

Also on page 2 it asks what the last address you lived at with your wife and what dates from and to. I still live with her at this address, so what do I put in the TO date??? the date filed?

The I130 is for an alien relative so technically you can use that form to petition for any relative - such as Spouse, Sibling or Parent or Child. Hence the reason for a question that seems redundant to you - but applicable to others.

I do not have my I130 in front of me, but I am pretty sure I just put "N/A" in response to that question - because the very first question asks who you are filing for (Spouse). I can check later to make sure - however it is possible that another acceptable response would be to put your name as husband again (even though it is redundant).

The answer to the last address lived question should be your wife's address in the Philippines - that is the way I answered that question.

I think you technically have to be IN the USA to file the I130 at the Chicago Lock Box location. You should check whether you can file the I130 petition and send it to the Chicago Lock Box even if you are still in the foreign country at the time you file. I was told I need to be back in the USA to file, but I may have not been given clear information so please make sure to check.

I know you don't have to be in the US, but you have to have a residence in the US. It's not possible for me to file in the US as I'm not there, but they won't let me DCF file here either because I don't have a permanent residency visa. There are no mail services here that will go to a postal box other than regular postal mail which is unreliable, so I'm going to send it to my parents (which is also the address i'll be using for my US/contact mailing address) and have them mail it to the lock box, so it will be coming from the USA.

The question about last residence with the wife is not about the address, but what the last date should be since we are still there and will be until her visa comes in.

I'm still not sure on the first page when it asks for petitioners address if I should use my US address or my filipino address. I think probably USA but I don't want to put the wrong one.

Yes, you need to list yourself.

Don't leave anything blank - write not applicable where not applicable.

Re the last date, if you are still living together, you can put: mm/dd/yyyy - present time.

Yes, when petitioning for a spouse the petitioner is listed as the beneficiary's spouse in that section.

You'll need a US address to receive notices of action from USCIS. I recommend putting your permanent US address (could be a family member's address etc.) on the cover letter with an explanation you are currently on an extended visit abroad.

Question 17 says Information about the alien relative (continued). The way the answer is on my I130 form it says the name of the beneficiary.

This form was filled out by my lawyer (sigh) and now that I read it again I think you are correct. This must be a mistake on the form when I filled it out.

I don't know if this will create much of a problem or not, but the person applying for the visa is my beneficiary so hopefully the DS-230 form will make that clear.
