2nd RFE.....Are you kidding me????

Just when you think you've heard it all....

My case had been reviewed and I got a RFE because I forgot to send a copy of my husband's passport...According to NVC that was the ONLY thing that was wrong. So, I sent it and they put it on the bottom of the pile of cases to review so at 7 weeks they send me another RFE!!!! This time, it is because of the new ruling requiring a new police record if the previous record was dated prior to June 14th. YES, I was aware we were gonna need to get a new record and provide it at the interview but didn't realize that we would need to have it prior to getting an interview. REALLY????

I don't think that is fair. They already told me the file was good with the one exception....I think they should have advised me that at the interview I will be required to have a new police record but not hold up the process of getting an interview.

My question is....what keeps this from happening again....how many RFE's can one person get??? Is there an expedite I can request due to the length of time and the unfairness of the situation??? Anyone with this or a similar situation??? Multiple RFE's???

08-10-2010: 2nd RFE for an updated police record-although the one we have was dated 4 months ago......ughhhhhhh

09-01-2010: NVC received checklist letter with a new police report..

09-23-2010: case complete FINALLY

11-12-2010: Interview-blue slip, need of a co-sponsor & petitioner at interview

12-07-2010: Petitioner interview w/co-sponsor paperwork

that happened to me. (sort of)

i thought we just had to take the PCC to the interview, not submit it to the NVC unopened to get sent back to japan unopened.

but we found out that we had to send it with the IV pack.

so our case took almost 1 extra month to process while we waited for the document. and since we took longer at NVC we got stuck with the busy summer interview season and had to wait 2 months for an interview.

i know it's hard, but just stick with it. it is almost over. RFE is not so bad!!! :thumbs:

HELP!!!

Nothing can stop NVC from requesting documents that they feel they need to adjudicate your case. All you can do is send the requested information and hope for the best. Good luck on moving forward.

I wish there was a way to expedite the case too but i think the only thing we can do is send them all the information they request at any stage of the case and wait for the next step

we have no control over how fast they process the case

December`98-left US after 13 month stay-didnt overstay

March 2001 EWI-

July 22, 2004 got married-

July 23,2007 mailed I-130

December 17,2007 -I-130 approved

March 4,2008-son born-

January,2010 fees paid

June,22 2010-DS-230 and I-864 sent

June,29 2010-DS-230 and I864 in the system

August,11-RFE-all about J-1

August,12-additional requested document sent now waiting again

I don't see how it is unfair though. You forgot the copy of your husband's passport, not them......

I do agree it is silly that they didn't bother to do it all at once, it would save everyone time.

No, I do accept the first RFE...it was my fault...but at that time they had a valid police record and only said I needed to send the missing copy of the passport....it is only now that they have changed the policy about police records and are requesting a 2nd record be PURCHASED although the previous one was already cleared.

What is this new policy about police records? I remember you mentioned in your first post that you needed a new police record after June 14th. What was that June 14 date for?
