Hello everyone,

My husband and I have found a joint sponsor. However, in the I-864 that my husband is to fill, it asks for a copy of tax return. Even though he did work a little last year, he has not filed taxes in the past 2 years and cannot fid the previous years tax return. What do we do in this case. If we are using a joint sponsor is it still necessary to include my husbands tax return nformation?

11/15/2010- Received 3 hard copies NOA1 (485, 130, 765) dated 11/09/2010

12/6/2010- Received RFE to prove we meet the 125% of the poverty line. (Currently waiting to file taxes and send this information in.)

12/25/2010- Received Biometrics letter dated 12.21.2010 for Appt 1/18/2011

1/6/2011- Successful Walk-In Biometrics

2/17/2011- Responded to RFE

3/10/2011- Received email that Work Permit card production has been ordered

3/14/2011- Interview notice for April 19th received(Mailed march 11)

You will need something from your husband, regardless. He will either have to file, or write a letter explaining why he didn't file.

You really only have to have the prior year's tax info. The 2 before that are optional. If you want to provide info for the year you are missing, you can call the IRS and have them fax or mail you a transcript.
