k1 convicted and problems

Im over in the U.k and was wanting to apply for a k1 to come to America to marry my fiancee but after consulting with an immigration lawyer, I was informed that due to criminal convictions I will have difficulty in obtaining the k1. The lawyer stated that he would do further research for us but it would cost over $150.00. So we are thinking another option is to marry here in the U.K and then for me to apply for a k3 and see if we have any better luck that way, has anyone else had simular experiences to us and if so how did they overcome them? please help me marry my soulmate !!!

A spouse is just as excludable as a fiance(e) when the issue is criminal behavior.

Pay the attorney for the research, or better yet find an attorney who has enough experience with the issue that she already knows what to do without needing the research. (Do you really want an attorney who will be learning the ropes on your case?)

I know of someone who filed for the k1 for her fiance and although he had a criminal record - for drugs - he was still approved. hope this gives you hope.

07/2011 - Moved back to Brazil

It depends on what the conviction is for. Is it a felony or misdeamenor? Does it involved violence against women? If it is violence against a woman, your chance might be slim but it depends on the consular officers handling your case. Goodluck.

Just for purposes of clarity... your fiancee, the USC, is the one who will do the filing for either the K1 or the K3, should you pursue it. She petitions for a visa on your behalf.

But that does not, in any way, change the implications of your criminal record as others have addressed. You may have better luck having her move to the UK to be with you there.
