RFE after Approval at the Interview

On June 11th, my husband and I (USC) went to our interview which went great. At the end, the officer gave us the ROC letter and told us that he had been approved. Since then, we haven’t received any welcome letter or communication from USCIS.

On July 26th, we called the hotline to see what was going on. Two weeks later, we have received a RFE for his birth certificate, translation of it and a certified copy of a marriage registry (which I am assuming is the marriage certificate). All of which we sent with our original AOS package and saw during our interview at the same office we have to send the RFE response to. In fact, I sent 2 certified copies of our marriage certificate then.

Has anyone heard of this happening? I feel like they are just requesting something to come up with a reason why his paperwork wasn’t processed. I’m working on getting another certified copy of our marriage cert. and we have a spare translation of his birth cert., luckily.

We leave for Italy at the end of September to visit his family and I had really wanted him to have his GC by then. We have an InfoPass appt in less than 2 weeks and I think we might ask for his passport to be stamped just in case it doesn’t happen.

RFEs can be given at any time for any reason. Respond to it with what they request. DO NOT leave the country unless he has...

1. His green card IN HAND

2. An AP IN HAND

Be SURE that the AP has not been suspended pending the response of your RFE.

Yes, if he doesn't have his GC by the time we leave, we will bring his AP.

As for our Infopass, we will use it to double check and make sure he can leave the country without running in to problems.

We went to our InfoPass this morning and turns out that my husband's application is still pending in the system. Even though we have a ROC notice saying he was approved, the officer said that a supervisor still needs to approve it. I think it is all an excuse. I told her that I knew if the application needed to be review by a supervisor, they usually give a different paper at the end of the interview which was far different than one saying that it was approved! They wouldn't accept our response for the RFE either, although I wasn't really expecting them too. So, it looks like his AP is still valid.

We next dayed the RFE response. So hopefully, this will end soon. I still believe we received the RFE to somehow justify why our application wasn't touched after our interview. Best case scenario, they will push everything through once they get our response...
