I-130 Document Copies

So,

My husband sent off the I-130 petition a few weeks ago and I had left him specific instructions on the order the package was to be in and what to make copies of. Well, he put them in order alright....including every copy as well as our son's original birth certificate (60 dollar fee for the document and its expedition) as well as the whole money order, he didn't even rip off the receipt part. I was furious to say the least when I realized this, which was not until a few weeks later. I thought that my instructions were thorough enough, but obviously that wasn't so. He also "assumed" as he said that they needed the copies.

From now on I will let him read over things with me, or make sure that i'm there to send off the package with him. He leaves it up to me more, as I like to control things like this, but he should be familiar with the whole process as well.

Anyways, we received NAO1 in the mail this past Monday (August 9), but what I wanted to know is if not having the copies of all the forms filled out will be a problem in the near future? Also, is there a way that I can get back my son's birth certificate from them, or am I better off requesting another one? I know I will need it again during this process, and I also need it for his application for his certificate of birth abroad.

re: birth certificate -

IF INDEED you are filing for a 'Consulate Record of Birth Abroad'

then you'll need to show an original or certified copy (certified by the issuing authority) of the birth certificate, to any Consular Official that's handling yer CRBA casefile.

If you were counting on CRBA, then, IMO, the child's birth certificate wasn't needed for the foreign spouse's I-130 petition submittal, at all.

Sure, a regular photocopy MIGHT be useful to show any 'bonafide marriage evidence ' (LOOK ! We had a baby ! ) but for now? That original is gone, you may or may not see it again on interview day.

re: yer marriage certificate - photocopy only, with original I-130 submittal. Original to be submitted to NVC.

re: USC's divorce documents - photocopy only, showing 'certified copy seal' legible, somewhere on the photocopy, with original I-130 submittal. Original is shown on interview day.

Join July 2010 filers' club!

It is difficult to get your son's original BC back from USCIS. Call them and check with them. If not, better get another original.

Having copies of an entire package is optional, but it would be helpful for any back reference in future or to submit to your beneficiary later at his/her interview time, just in case.
