Hello VJs,

Are you one of the victim who is still waiting for NVC to receive their case after approval?

In my case:- it's been 22 days today of my I-130 approval but NVC has not received my file yet. My approval notice says "we have sent your original petition to NVC". I talked to NVC people and have sent a copy of my approval notice for them to research and still waiting to hear back.

Why it always happens with me? My I-130 was approved after 42 months of long wait (LPR filling for spouse) and now when I-130 approved, NVC did not receive my case which usually suppose to take not more than 1-2 weeks. My priority date is already current. But nothing is happening.

Anybody has any idea? What steps can I take now?

Thanks,

HI malvi

I had the same problem, I contacted NVC 60 days after I had received my I-30 approval letter from USCIS (National Benefit Center). Representative from NVC gave me an email address: NVCResearch@state.gov " told me to attach a scan copy of my Approval letter with the email, and also told me to write in the subject: your EAC#, and write Sir/Madam, my name is....my DOB is....my beneficiary's name is....her DOB is... nvc has not receive my case so far. Please locate my case. Thanks. Note:I've attached my approval letter with this email".

After 15days of wait they (NVC) replied me stating that they have found my case at Los Angeles field office, and told me to contact USCIS 1800 375 5283 for this matter. I called USCIS and talked to an officer, not a representative. You have to explain to a representative that your case has been approved long time ago and you've contacted NVC for this matter they (NVC) told you to contact USCIS then representative will transfer you to an officer. Be very kind when talking to an officer, don't show any anger in your voice but show your sufferings, frustrations. Tell the officer that NVC has located your file.....office and emailed you to cantact USCIS. Could officer direct that field office to send your file to NVC. Wait about a month your file will go to NVC.

This was my situation and after 4 months later of receiving my approval letter (I-30 for spouse) it finally went to NVC. Good Luck. I will keep you up to date about my case.

I'm a Green Card holder, applied for my wife in:

October 01, 2007 at Vermont Service Center

January 30, 2008 received Receipt letter

January 04, 2010 received Transfer letter to NBC Lee's Summit MO 64064

March 26, 2010 received Approval letter from NBC, saying will transfer file to NVC in 90 days. But transfer to Los Angeles office instead !!!

August 10 2010 Los Angeles office transfer my file to NVC. Now waiting for their process. Hopefully everything will be on schedule with NVC. By the way I will be citizen within next 3 months. I will update my case with NVC after my citizenship.

Thanks for the detail information Shawon. I appreciate it.

In your case everything seems to move pretty slow. I wonder why you waited 60 days after approval to contact NVC? 3 months after USCIS approval to receive case by NVC is too too long. I have already waited 3 and half years down the line for I-130 approval. NVC should realize the pain that we went/going through.

I have been waiting for NVCResearch reply.

I have seen lot of people's cases have been transferred to LOS office before they transfer it to NVC. But LOS doesn't have my jurisdiction so I don't think they have received my case.

Lets see what NVCResearch dept. come up with.

-Peace

I did not want to wait 60 days but my approval letter stated to wait at least 90 days before contacting NVC. So, I gave them a fair shot. But nothing fair in immigration's book. They can do mistake and get away with it. They don't want to explain anything to you. They think you are an immigrant, does not know English much or have poor accent, so these are lower class people, then why do we have to explain anything to them? I had very bad experience with an immigration officer. All I asked him was why my file after 4 months later has not reached to NVC (used a very polite, soft voice) and asked could you plz tell my why?.But he shouted to me "Wait OK" wait 6 month then call us if nothing happened. I asked him again gently "why do I have to wait 6 more months when my approval letter says wait 90 days"? and I've waited 90 days already. He shouted back again, "Wait OK then call us", is there anything else I can help you with? I said no. There were few things came up to my mind after that conversation. 1st: I'm Muslim so some Redneck might get upset seeing he has to explain to a Muslim third world citizen. Or 2nd: he might have thought "they came here for better life so they have to sacrifice, they have to suffer, why I've to explain it to him". Not every immigration officer is a Redneck though. Other day, I talked to an officer name Chao(eventually an immigrant descent) explain every thing to me nicely with eager in her voice. Anyway, we came here for better life so, we have to sometime take this #######!!!

Keep me posted malvika. Hopefully from now-on, everything will go smoothly.

Thanks for sharing your experience Shawon. I know how USCIS people work. By the way what state are you from if you don't mind telling me?

The only thing I'm waiting is NVCResearch reply, I have to see where my file is lying and then I will take necessary steps.

I'm from New Jersey. On August 12, NVC contacted me for Affidavit of Support Fees. They're finally started to work on my file. It's really good news. Now I want to see how fast it can be over.

Thank you and wish you a speedy journey @ NVC :)

Malvika,

Congrats your I-130 is approved and wish it would soon be at NVC. I want to ask a specifica question.

#1 Did you file your I-130 on your own or through lawyer. Is it ok to file on own as it is very strighforward case.

#2 There is question 21 in I-130 form. "21. If filing for your husband/wife, give last address at which you lived together. (Include street, city, province, if any, and country): from: To". In case of Greencard holder went to India for 6 weeks and stayed together with spouse 3-4 weeks after marriage at native address. So answer would be for this question 21 is home address and period would be 3-4 weeks. Is this correct. Did you have similar situation and what did you fill.

Thanks

Thank you immi_mygc,

A. I filed on my own as it is straight forward. Read the instruction carefully before filling up the form.

#2 There is question 21 in I-130 form. "21. If filing for your husband/wife, give last address at which you lived together. (Include street, city, province, if any, and country): from: To".

A. Yes, you are correct. The address would be where you lived together and 'From' and 'To' will be the period you started living together and until when you lived.

Hope this is clear now.

Good Luck

Thanks Malvika for quick reply.

I was theref for 6 weeks for marriage and then lived 3-4 weeks together and then I have come back. So technically it is 3-4 weeks lived together.

Also forgot to ask, did you submitt any additional document related to marriage apart from marriage certificate. I am including few wedding pics + recent Indian life insurance doc has her name + copy of wedding card. Hope this is enough.

Yes, I submitted Relationship certificate, two affidavits of marriage (written statement by someone other than your family member who was invited in marriage), birth certificate of my wife etc. It's been long and I don't remember what exactly I submitted with I-130 I have to check my records. But please read the instructions it will clearly tell you what to include. That's what I did. Good Luck.
