pardon, I totally forgot.

fastest way to get my wife into usa

EB-5 Visa.

so here is what im going to do

i made a cover letter requesting a cr-1 visa for my wife

im submitting an i-130 along with g325 for both and check for $355

i also got a copy of the marriage certificate in english along with copies of my us passport

once i submit this and its approved.....the ds 230 will be mailed to me by nvc or i have to go grab it somewhere?

i would get a lawyer but while i was over in pakistan getting marrried, my company shut down and i lost my job

so im jobless and i cant afford a lawyer thats why im trying to do this on my own and not spent whatever i got left.

i recently married my childhood friend, she resides in pakistan and im a us citizen

we got married in karachi pakistan. and im trying to figure out the quickest way to get her into the usa

can someone please help me?

she is pregnant and i want her to deliver the baby in usa not in pakistan.

so far i have filled out the i-130 and have all the documents needed

i was wondering if i can submit the k3 forms along with i-130 or do i need to wait for it to get approved.

also i have a criminal record, misdemeanor first offense, will that affect my application or the wait time?

im just trying to figure out whether to stay here or leave the country to go back to my wife.

Just for your information , I used blossoms.com to file a fiance visa back in 2006. They do a pretty efficient job. Of course you could do it yourself, I don't have the patience for all that detailed stuff. One mistake and it't going to cost you.... I hired a lawyer this time he filed electronically.

so here is an update

i just called the uscis and they told me to file for an I-130 wait to get a receipt number

and than apply for K3 using i-129f

when i asked her that K3 was no longer valid she checked with her boss and adv me that was the fastest way to go

so im confused as hell...anyone?

If you don't want to read it for yourself be prepared to pay about $1,000 to $3,000 (exact amounts vary widely) to an immigration attorney that did read. Don't be fooled by anyone that says they can get her here 'quick'. It's a process with multiple steps whether you do it (keeping your money) or paying someone else to do it.

Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:

The nonimmigrant K visa will be administratively closed

You can petition for a K-3, please do not think you cannot. I-129Fs and I-130s have been being approved on the same day and sent to NVC at the same time for years now

according to a tier 3 representative at uscis. k3 is still an option to be used to bring my spouse over to USA.

Please be aware - once you submit the I-129F -

the I-130 gets yanked out of it's current queue position -

and then put BACK a bit, into the current queue position of the I-129F -

this 'queue jumping' will delay any approval from 5 to 11 weeks.

Sadly, the two casefiles will be joined up at USCIS, then both are approved on same day, and will travel together INTO NVC.

Once at NVC, the I-129F casefile will be administratively closed, and there is no way to go forward with any K-3.
