I am defeated and devastating.

This past March we had our i-130 interview. The embassy requested an i212 because my wife lived here for some years with a pending asylum. 4 years ago I married her, We hired an expensive lawyer who misguide us and now I am feeling dead inside.

The embassy request an i212 to be filed at my local USCIS office in Fort Lauderdale FL. The consular officer did say that my wife is consider as deported. However, the C.O did not request an i601 just an i212. I don't know why maybe she is going to do it it one day when we get the i212 approved. I filed this i212 form but it is not moving at all.

As you can see my situation is traumatic and on top of that we have a 2 year old baby. I want to be with my wife and my baby.

My question is: What can I do ? Some say that she should move to the Bahamas so I can visit her every week. Others say move to Canada. Traveling to Canada is cheaper than South America.

I need some help I am losing my mind I am in deep sorrow. I feel dried inside. PLEASE HELP ME!

Feb 5: Interview date scheduled. Interview on March 23, 2010

Embassy Journey 1.0

March 23, 2010: Interview date. Wife placed on AP, Baby required new birth cert.

April 21, 2010: Wife out of AP she needs to get an approved I-212 from USCIS, Baby birth cert. issue resolved.

I-212 Waiver @ USCIS Journey

May 10, 2010: Filed form I-212

Sept. 9, 2010: I-212 Approved

Embassy Journey 2.0

Sept. 22, 2010 New Interview date.

Sept 22, 2010 VISA APPROVED.

Waiting for visa to arrive at Cali-Colombia.

I would suggest you wait to see if the 212 gets approved or not.

Talk to another lawyer - one skilled in immigration matters.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

you might want to visit http://www.immigrate2us.net - they focus more on these types of matters, and

if yer gonna hit up another attorney, suggest you engage Lauren/l Scott.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I feel for you, mate. I believe that indeed you need to switch lawyers and discuss the options with a GOOD immigration lawyer because a lot now depends on the timing of events and court hearings might be involved here; also the personal circumstances surrounding your wife's previous status will make an impact so you need to address these in detail over VJ for some experienced members to help or best start with a GOOD lawyer.

My 2 cents: Start a new topic and ask for information on GOOD lawyers in your area, I am sure someone in VJ would know one from experience. Otherwise, you need to wait to see what happens with the i-212 since it is being processed from what I understand.

And never be defeated, man! The VJ community is always with you :) Let us know how things go!

Before you start making plans, see if the I212 will be accepted.

Just so you know, you cannot just pick up and move to Canada. There is a lengthy, and not guarenteed, immigration process to Canada. The immigration system works quite differently than to the US.
