I was told to post here, my F4 Visa case:

I currently live in Canada with my parents and my uncle has sponsored my dad for permanent U.S. immigration. My uncle is doing F4 Visa, for brother/sister. My dad got the VISA approval this past September, but no VISA's available yet because of too many applicants.

I'm curious to know, if my dad gets sponsored, will he get his Green Card right away? Or will we have to wait a few more years after he's landed, to get his Green Card/LPR? Apparently, this will affect if I'm able to immigrate with my dad at the same time.

Again, here are the dates:

Petition date: April 2003

Petition approval: August 2009

Date that my dad received VISA Number: (Unknown)

My date of birth: August 1988

P.S. I know I'm 22 right now and would be considered an adult, but under the Child Protection Status Act, I could be still considered a child when the VISA number becomes available.

You petition year is 2003 and your approval year is 2009, so you can substract 6 years from your current age 22-6= 16 so you will be eligible. you can also call NVC with the case # and petitioner's DOB and they can also tell you over the phone regarding ur case..:thumbs:

Received e-mail notification last night that 2 of our family's 4 EAD cards have been approved and sent for production. Hope to hear about the remaining two soon...

Timeline:

8/27 - Mailed AOS & EAD packets (myself, husband & two sons)

9/2 - All Received at USCIS

9/14 - NOA1 hardcopies received for all 4

9/23 - Biometrics Appointment Notices received all 4

10/14 - Biometrics Appointments Scheduled date

9/24 - Successful biometrics walk-in

9/27 - Touch on all 4

11/1 - E-mail notifications: 2 of the EADs approved and card production ordered

I wish I was done with embassy like Ricardo.I've been to the embassy 5 times for working visa. I always get through but this time it will be on a different level.kinda make me nervous

Yes, I think I should be fine. The current PD date for F4 is January 2002, and my dad's date is April 2003. So I believe it'll take about 1-2 years for my priority date to become current.

The only way I could see myself not being eligible is if my uncle didn't put my name on the petition. Visagrant, you said I could actually call NVC and find out?

Yes, Call NVC and talk to a supervisor and then let them know your query.Just make sure they include you in the IV fee payment, then you are good to go..:thumbs:

You are part of the derivative of the beneficiary, so even if your uncle didn't put your name on the petition, your dad can add your name in the DS230 form.

Based on the current processing time, i think your PD should fall within 6 months :innocent:

You don't have to worry about anything.First of all you are covered under CSPA; from the details you have provided your CSPA age comes out to 16.(you can check the CSPA calculator here:- CSPA CAL.).

To qualify as derivative beneficiaries on the petition for your father, the only requirements are that 1) you are not married, 2) your CSPA age is under 21, and 3) attempt to adjust your status within one year of your father's PD becoming current.

When you father's PD becomes current;he will get a letter/email requesting the AOS fee (I-864) and IV fee (DS-230)

As VISAGRANT said,you can call NVC and talk to operator at:-(603-334-0700),between Monday through Friday from 7:30 AM to 12:00 AM (Eastern Time).

You can also ask NVC that you qualify for CSPA or not.(I called NVC for my case and the operator said that i am covered under CSPA.I am in F4 category,current age 21.)

Don't worry about if your name is in the petition or not,call NVC and let them know,just make sure that when requested by NVC your AOS fee and IV fee are paid.

September 24,2010 : NVC sends Email that case is being processed under CSPA Act of 2000.

September 28,2010 : NVC Receives DS-3032(E-mail received from NVC).

December 11,2010 : AVRS says documents missing, NVC has mailed a letter on Dec. 10.

December 18,2010 : Missing Affidavits Sent.

December 19,2010 : Checklist Cover Letter Received from NVC.

December 21,2010 : Corrected Affidavits Sent.

December 25,2010 : Merry X-Mas. AVRS says checklist response received on Dec.23; need 4-6 weeks for review.

January 12,2010 : Happy NEW YEAR. AVRS says CASE COMPLETED :)

January 25,2010 : Sign in Failed 2300 HRS IST :)

Hi i'm new in here.

My sister petitioned me and recently she already payed the IV fee of $1,616.00 for me, my husband and my 2 kids. It is last October 28th to be exact.

As i check on the Immigrant Visa Invoice Payment Center it is already paid dated October 29th.

I would just like to ask if I have to wait for a letter coming from NVC regarding the DS-230 package or should I send it as soon as I completed the required civil documents?

Just print the barcoded IV coversheet from Immigrant Visa Invoice Payment Center and send the DS230 package with the required civil documents.:yes:

If you send early, you may get a December Interview..:thumbs:
