hey

i am new to this site and to the process. so i dont know a lot about a lot of stuff. and hence, need help from you guys.

my maternal uncle filed the petition for my mother in april 2004 which was approved on october 19, 2009. But by then, my brother had turned 22. and i will be turning 21 this august.

the letter said that the petition has been sent to the NVC which will process the petition. now, i want to know what should have been done after that? due to a lot of family problems, nobody could track the case actively. we thought that we will be informed in due course of time. but today i decided to see what is the status. i realized that i would be turning 21 soon when i started looking things up, i read about the CSPA too.

will my brother be benefited by this? and are we just supposed to wait for some intimation or pull some strings? what is to be done?

plz help. i am really apprehensive about this.

Though i dont know much but i guess you have to submit the visa fees following the affidavit of support . Im confused about the age problem , hopefully someone else can know the solution .And since ur PD is April 2004 , it can take around more 4 years for your PD to become current .

CORRECT ME IF IM WRONG

PD is 12 DEC 2000

Whats up once again guys! Still no reply from NVC regarding my Aunts petition for my Dad.Its been like a month a now since she she submitted all the documents. We're starting to get nervous now. And sad part is, when I called the NVC automated no., automated machine said that "they have no record of the case no. maybe because they haven't received it yet or hasn't reached their office". That's really messed up! Anyone heard this message before? Need some answers, comments, suggestions or advice please! Thanks!

CSPA can and will only be calculated when your priority date is current

True to some extent...but to calculate CSPA age, u need only priority date as per approved petition and the approval date and the age at the time of approval..

Hi Alvill,

Your brother got lucky, we are on the same boat, my mom's PD is also April 1, 1988, my brother's DOB is Mar.6,1987, basing from the CSPA calculator he has aged out. Unfortunately his name was not in the invoice, so I'm still figuring out what we can do to have him go to he interview. My parents have a scheduled interview already for May 19, 2011, they will go to St. Luke's next week for the medical. I will pay whatever fee they will ask as long as my brother is included! I am already here and I am a USC but we decided to pursue my uncle's petition for my mom with the hope my youngest brother can migrate with my parents. I guess more prayers for us too! As for your question, if things are all ok then your family should not have any problems migrating this year.

was away for awhile,i just feel bad,so disappointing feeling of losing the amount of 1226 USD and a 100% of effort so the whole family could travel unfortunately my 2 kids who is 25 and 26 was denied of overage.i really really feel bad.i just wanted to share to those derivatives of this category that although you are included in the fee bill, medical and interview if you think you are below 21 on computation of the cspa age then go for it but if you are in doubt it is a choice to gamble.here is my data:my petition was filed jan 21,1988 was approved feb 15,1988 i received notification last june 20 2009 that our priority date is current and completed necessary documents november 6 2010,was set for an interview last april 28.on the other hand i was granted a visa with my minor kid who is 15.still waiting for the result of my husband sputum on the 17 of may. the CG told me to go first then petition my kids who are aged out that will be on the F2b category another 13 years on the waiting for my daughters to follow.haizt a very long process.

cspa can only be calculated when priority date is current, it is a big part of the calculation since u must use age when priority date is current.... I am talking from experience as someone who benefited form it and did a lot of research

Agreed and thanks for your expertise..

But NVC usually contacts the petitioners around 6 to 9 months before the Priority Date become current and at the time of fee payments, the CSPA eligible petitions payment info will also be available for payment..
