What's up guys! I'm new here and I just have a couple things that needs clarification. First of, this case is an F4 petiton that was filed by my Aunt for my Dad. My Dad has a PD of Apr 01 1988 which will be current next month based on the visa bulletin for May(PHILIPPINES). All the necessary paperwork have already been filed and all the fees that needs to be paid have been paid as well. The NVC said that the case is still under review and to wait for their response within the next 20 days. Now my question is, how long will it take for my Dad to get an interview date? Remember his PD will be current next month.

The second issue that I have, is if my brother will be granted a visa as a derivative. My brother is 25 yrs old but his name is still included in the Invoice Notice asking him also to pay for an IV Fee. Its just confusing because I calculated his age through the CSPA calculator but its showing that my brother has aged out but if thats the case why did they even asked him to pay for an Immigrant Visa Fee? $400 dollars aint no joke! Even I, who is 29yrs old is also included in the said notice as a derivative but since I'm already here in the States, we just ignored it. So we ended up paying for 3 people, my Dad (beneficiary), my Mom and my 25 yr old brother (derivatives). What do you guys think? Will my brother get lucky and be included despite being 25yrs old?

Hi Alvill35,

After you paid all the fees and submit all the documents for NVC. It takes them 6-8 weeks to review it. You can call NVC and check if you have submitted all the requested document or not. If you did, the NVC will tell you the completed date. Usually, it take 6-8 more weeks after the document process has been completed, NVC will schedule an interview date for your case and send all the document to embassy where you have the interview. You will be notified soon, I guess, because your PD will be current next month.

About your brother, you paid for him even though you know he is aged out, but it is still fine. Let's see if his name is on the interview letter. If he is not and you are sure that he is not qualified for CSPA , you cannot do anything to make him not aged out. I think you can get back $400.

If his name is on the interview letter, go for the interview, and if this is the case, may be your brother is not really aged out as you thought he was. :)

Hi Alvill,

Your brother got lucky, we are on the same boat, my mom's PD is also April 1, 1988, my brother's DOB is Mar.6,1987, basing from the CSPA calculator he has aged out. Unfortunately his name was not in the invoice, so I'm still figuring out what we can do to have him go to he interview. My parents have a scheduled interview already for May 19, 2011, they will go to St. Luke's next week for the medical. I will pay whatever fee they will ask as long as my brother is included! I am already here and I am a USC but we decided to pursue my uncle's petition for my mom with the hope my youngest brother can migrate with my parents. I guess more prayers for us too! As for your question, if things are all ok then your family should not have any problems migrating this year.

Our parents have the same PD but yet your parents already have a scheduled interview? I wonder why? Im kinda worried now.

If the PD are same..then there is no way one can be ahead of other as NVC goes by the date in Visa Bulletin..:yes:
