Hi Ricardo,

Thanks for the reply, the approval notice is that the I-797 too? My uncle(the petitioner) told me that he did not receive any correspondents from USCIS since the time they filed the petition(he's 77 years old) so I'm not quite sure how we go about getting the approval notice. I did get a copy of the I-130 from NVC which had a date stamped approved/recommended by from Seattle local office April 21, 1988(which I think it's too soon for an approval) and another stamp that says entered June 3, 1988. Is this even possible to get an approval in 20 days from the local office? Where can I get the approval notice? I guess if these dates are true then according to the CSPA calculator my brother is not qualified. I really want him to be able to migrate with my parents 'coz he will be the only one left back home. Thanks again for the reply and I did e-mail the US embassy in Manila about half an hour ago to check his "eligibility", I will keep you guys posted.

there's no other form that's used to get the approved notice etc. review the information at the link below

also .. maybe you can speak with a senior person at USCIS and see if they are able to send it out.. let them know that one was never received.

Hi Lexlee,

I have tried this I-824 and it took long time. I am lucky because my name was already on the interview letter.

I can help you with the calculation of CSPA. You need the receipt number. It is shown on your first I-797. It is usually start with LIN, WAC and...

Check my case status of USCIS site https://egov.uscis.gov/cris/Dashboard.do . You type your receipt number into the box, it will show the latest information of your case. It usually show the date of approval of your case.

If you know your Priority date or receipt date (in your first I-797),you know your approval date (in your second I-797 which your uncle has lost, but you can use the link I provided to find it out, or you can look at your case number start from 3 letters and 10 numbers, look at the first 4 numbers. These numbers are the year USCIS approved your case and transfer it to NVC)

and your brother date of birth to find out the CSPA age . USE this CSPA Calculator http://vietditru.com/CSPA_Calculator.php

Good luck

I hope this help you :)

Hi carol,

Thanks for all the info unfortunately I don't have their USCIS case number the only number I have is their NVC case number, and my uncle don't have any other info either, I am thinking of doing the I-824 but I'm not sure how they can trace/track it without the USCIS case number, I will try to contact USCSI to see what they can do to help me, it's a 23 year old petition and it might take awhile to get more information from them. Anyways, thanks again

For the I-824, it usually takes 3 months, sometimes it is depend on where you file it. Check it out https://egov.uscis.gov/cris/processingTimesDisplay.do;jsessionid=abc3mi_gg4RZufi6W7-7s

Look at your NVC case number, there will be 3 letters and 10 numbers. What are the first 4 number? it should be a year. For example, HCM2002123123. 2002 was the year USCIS approve your case. Use this year to calculate the CSPA

Good luck.

Just to include precisely to what carol said, Take for example NVC case number HCM2002623123

HCM - Name of the Consulate

2002-Year in which the petition was approved

623- This is according to the Julian calender and you have to look for the number after 500...so 500+123..123 happens to be on May 3rd

123 - You case processed on that particular day

So May 3rd 2002 is the approval date for example HCM2002623123

HI Visagrant,

Thanks for the informative reply, I tried that Julian Calendar to determine my parents' approval date it looks like Oct. 9, 1988. the last 6 digits of their NVC case number is 155282, so basing from this am I correct to say that it is Oct. 9, 1988? I also used the link to determine my brother's CSPA age, he has aged-out already :( . I am getting frustrated, he was only a year old when this petition got approved and 23 yrs. later he still aged-out. Do you happen to know if the retention of priority date is still in court? 2 lawyers I have talked to said that they have been denying these application 'coz it is only good for certain family based categories and F4 is not one of it. Let's keep this thread moving!

Based on the number u gave, it turns out to be June 4th, 1988. Due to the early approval of the petition, ur brother is not eligible for CSPA..Had the petition approval been happened on 2005, he would have been eligible..

Once ur parents r in US, then they can petition for ur brother in the IR category, meanwhile ur brother can try any other work permit visas like H1..

Good Luck
