No,it means after your interview date is appointed, and you fail to go to the consulate, you will have to wait the next fiscal year because your VISA number is retrieved.

If you go to the consulate but fail to issue the correct documents, you will be asked to submit it within one year. After one year and you haven't submit it,you will be looked as "rejected".This is what I think.

Thanx for reply

Hello Everyone - my sister and her husband finally here after a long wait. As per CSPA Formula Worksheet their two sons who are single and aged out I mean they are over 21. Is their any exception or any way with any legal help they can join their parents? We are hearing lot of rumors but could not find any solid response but worth to put my issue here with VJ members if somebody experienced this. After doing all CSPA calculations one was 21 years 81 days and other one was 26 years 317 days. I'll appreciate sharing your experience and advise. Thank you!

ITS mean their age out like me. now my cspa AGE has been out 21 years and 19 days.

and we don't have such type of cases who went through this situation

Wait for PD retention law has not been pass untill we cant get immigrant visa as soon as earlier.

but our parents must be file new petition for us and USCIS will allot us SAME PD and upon approval we can apply for visa without waiting visa numbers.

One CSPA pd retention case pending in US supreme court and Lawyer carl shusterman said Might be the decision will be made at the end of this year or may be more months.

and if COmprehensive immigration law become law then PD retention automatically will be available for us for.

Just keep praying.

GOOD LUCK

.

I knew somebody will be out there with the same boat we are in. Thanks for the response and I am sure you are working with this issue long before I started. Should we wait for the GC of my sister or just file with the copy of visa which serves I-551 for one year. If I am correct there is no age limit for singles and what are you seeing in terms of I-130 approval time for F2B category? USCIS web site shows November 3, 2010 and what else I need to support I-130 in order to get the parents previous PD? Thanks again!

i am telling you just wait and pray for immigration reform or CSPA issue which is currently in US supreme court.

when law pass then USCIS will publish guidelines for PD retention process still we don;t have news regarding this.

if CIR pass then wait for USCIS instruction for CSPA PD retention i-130 process.

Hope this issue will be solve earlier and now congress done govt shutdown issue and yesterday obama said now whitehouse urge house to vote for immigration reform to get this done before the end of this year.

stay tune ill post everything when i have news regarding this.

Good luck all
