I suggest you don't. Merit-based track won't be implemented until 18 months into the enactment of the CIR (if it does get enacted) anyway. I think you should keep the sibling-immigration petition and see where it goes. Senate CIR is still subject to revision in next coming months during conference committee; who knows what will happen to the sibling category when the bill reaches the president's table.

And according to the bill, they are keeping the sibling category for 18 months into the enactment. There's got to be a reason for that. They won't be a clown and let someone be petitioned only to tell them later that their efforts and time were in vain. Keep the petition. With all due respect, as far as the US government is concerned, you just entered the line, legally.

i am just asking about withdrawing the later F3 petition my mom filed few months back...

Just afraid that I might lose my eligibility to get to merit based category....

Merit Based Category also requires points for work experience in US which might not be viable to your scenario...It is better to retain ur F3 too.yes.gif
