Scenario:

Mr X is an adult sibling of Mr Y(USC) who filed for Mr X

Mr X`s family have made it to U.S....sorted out their immigration papers

Mr X is unable to meet the deadline for entry into U.S

What alternatives does Mr X have to chew on fo a travel date that goes beyond USCIS deadline?

K1 Trip

6-23-2006: I-129 mailed

8-31-2006: K1 approved

11-15-2006: K1 Interview: done and visa approved

11-21-2006: K1 visa issued

11-27-2006: JFK as POE: Work authorized stamp on I-94

AOS Mission

12-16-2006: 1-485 + I-765 mailed

1-3-2007: NOA1 received: Notice date 12-28-2006

1-16-2007: Biometrics

1-17-2007: Case transferred to CSC

2-10-2007: I-693 RFE (whatever happened to the panel physician`s medical report?)

4-3-2007: Another I-693 RFE

5-8-2007: Resident Permit Card received Next Stop: February 6, 2009 (I-751)

Removal of Conditional Basis of Residency (Form I-751)

2-6-2009 Mailed Form 1-751:::VSC

2-14-2009 Received I-751 Receipt notice indicating one year extension of conditional residency status

3-6-2009 Biometrics:::::::::::::waiting for VSC

7-7-2009: E-mail notice received: Card production ordered

8-3-2009: 10year Green Card Received in the mail.

Naturalization Application (N-400)

2-16-2010: N-400 sent in..

5-18-2010: Interview

6-16-2010: Certificate of Nat. received- Masterpiece is a USC!

I graduated in US as an international student before I come back home to have an interview. I also missed the graduation ceremony. I do not know when the priority date becomes available again. It feel like we are all waiting in vain.

I haven't filed yet, planning on doing it this month. Long wait ahead....lol

September 13,2010 : Priority Date Current.

September 18,2010 : Successfully E-mailed DS-3032.

September 22,2010 : AOS Invoiced(Online Payment Portal).

September 23,2010 : AOS Fee Paid.

September 24,2010 : NVC sends Email that case is being processed under CSPA Act of 2000.

September 28,2010 : NVC Receives DS-3032(E-mail received from NVC).

September 28,2010 : IV Invoiced(Online Payment Portal).

September 30,2010 : IV Fee Paid.

October 28, 2010 : AOS Packet Sent.

October 29, 2010 : AOS Packet delivered at PORTSMOUTH, NH.

November 16,2010 : AVRS says I-864 received.

November 16,2010 : DS-230 Packet Sent.

November 17,2010 : DS-230 delivered at PORTSMOUTH, NH.

December 06,2010 : AVRS says DS-230 received.

December 11,2010 : AVRS says documents missing, NVC has mailed a letter on Dec. 10.

December 18,2010 : Missing Affidavits Sent.

December 19,2010 : Checklist Cover Letter Received from NVC.

December 21,2010 : Corrected Affidavits Sent.

December 25,2010 : Merry X-Mas. AVRS says checklist response received on Dec.23; need 4-6 weeks for review.

January 12,2010 : Happy NEW YEAR. AVRS says CASE COMPLETED :)

January 25,2010 : Sign in Failed 2300 HRS IST :)

One has until 6 months time from the date the visa is issued and stamped in the passport to enter the POE... :bonk:

A visa does not guarantee entry into the U.S. A visa allows a foreign citizen to travel to the U.S. port-of-entry, and the Department of Homeland Security U.S. Customs and Border Protection (CBP) immigration inspector authorizes or denies admission to the United States.

A visa must be valid at the time a traveler seeks admission to the U.S.

The only best option left is to enter within the time frame of visa deadline and go back and finish your unfinished agenda in your home country..:thumbs:

I'm happy to find this forum! Thank you for all the good information. Our situation is: I'm naturalized as of 2004. Filed I-130 for my brother in February 2005, became his legal guardian March 2006 (adult with special needs), and we are waiting until his PD comes up.

In the meantime, he's living here in the U.S. with us - he can't live anywhere else, INS refuses to acknowledge his disability and so even though I'm legal guardian/mother, they only view us as siblings.

Oh well, we wait and life goes on! He is now 40, so hopefully before he's 50 he will get through. Hopefully.

I'm happy to find this forum! Thank you for all the good information. Our situation is: I'm naturalized as of 2004. Filed I-130 for my brother in February 2005, became his legal guardian March 2006 (adult with special needs), and we are waiting until his PD comes up.

US citizen have applied for sister I130 and it was approved and is waiting for visa number to be generated (there is a quota for it).

She is also married, (she was married at the time of filling I130 petition and her husband name was mentioned in the petition)

1. Can her husband come with her?

2. Do I have to do some thing here for her husband?

How can I make sure both are getting immigration NOT only her.

PLEASE HELP

  1. Yes, Provided IV fees is paid and filed DS-230 for him along with your sister filing forms.
  2. Teach him the American lingo..Just Kidding...If u are being listed as the choice of the agent in DS3032 form, u know better how it can be helpful..:)
