Hey all, I have a question:

On the proposed S.744's SEC. 2302. MERIT-BASED TRACK TWO (e) (3) which talks about allocation of Family-sponsored Merit-based Immigrant Visas for the family-visa beneficiaries who have been waiting for over 5 years for the visa, it says that the authorized visas "shall be issued in the order in which the petitions to accord status under section 203(a) of the Immigration and Nationality Act were filed (8 U.S.C. 1153(a))."

If I'm getting this right, the ROW beneficiaries who's supposed to get a visa soon would have to stand behind the beneficiaries from the oversubscribed nations (Mexico, China, India, Philippines) should the S.744 passes, therefor having to wait longer than they previously would have been expected to. It's as if they are making us stand in one long line instead of the many lines we've been waiting in (by nationalities and family categories).

Is this really the case? Then won't this be unfair for ROW beneficiaries? Or am I not just understanding this correctly?

Hi

I have been reading up on all this as I am in f3..apparently the new reform if it is passed it would only be for the people who has a approved petition which takes along time :( i put mine in Feb 09 i never got letter saying it was all passed until mar 11..but definitely get them in because they might be doing away with that category hope this helps

I inquired about my status "Expired" on CEAC website I got below reply I thought it is useful so I am sharing:

"You are registered with our office as the beneficiary of an approved fourth preference (F4) immigrant visa petition, filed on July 18, 2001. Consular officers are currently authorized to process applications for India-born applicants in this category whose petitions were filed before June 2001. There is no legal provision for an immigrant visa application to be processed out of chronological order, even for pressing humanitarian concerns. Because priority dates can both advance and regress and often move at variable dates, it is not possible to project when this case may become current. NAME may also check current priority dates posted at the beginning of every month at our website: http://newdelhi.usembassy.gov/prioritydates.html."

Priority Date : 18 JUL 2001.

Interviewed Once : DEC 2010.

From : India.

Backlogged visa applications filed by U.S. citizens and lawful permanent residents (also known as “LPRs” or “green card holders”) on behalf of their siblings and children would be processed within 10 years.

so it means that the petitions who are filled 10 years ago and right now in NVC wating for the visa number will be current immediately after this CIR bill become law...please share your views ????????

so it means that the petitions who are filled 10 years ago and right now in NVC wating for the visa number will be current immediately after this CIR bill become law...please share your views ????????

No. They will not be immediately current. There will still be an annual quota although more visas will be available yearly to remaining categories since F2A will become immediate relative, unused visas will be reused, etc.

No. They will not be immediately current. There will still be an annual quota although more visas will be available yearly to remaining categories since F2A will become immediate relative, unused visas will be reused, etc.

yes.gif ..It means the per-country caps on family immigration would rise and unused visas would be allowed to be used in subsequent years which will reduce the backlogged cases within 10 years..

Even if your PD is current, you have to keep in mind the validity of the PCC and Medicals are for 1year only..yes.gif
