Sachin , Your brother's name was not on the list on interview letter , Can he still enter into the Mumbai consulate without name on the letter ?

Have you discussed this with NVC or consulate ?

Ans. No , he cant enter into consulate .,but if CO realize that still he is eligible under cspa then they will give letter to my mom like send this boy any day when consulate is open at 7.30 for his individual inter with required docs.

Because if CO will decide his case on interview day , then he must be definitely present at the Embassy.

And will he go to the Embassy without Medical done ?

Ans. yes , he will wait outside the consulate .he is coming with us at 25 jan..lets see what happens. yes his medical is not completed yet, so that consulate will give 221(g) letter for req docs.

I will be thankful to you , if you answer me these question. This would help me and others who can be effected from retrogression and CSPA to learn about the current cases and Laws.

Ans. Sure..i will update every detail about my case and abut CSPA .dont worry . and yes., i also tried to contact NVC , consulate by facebook and by email also.

NVC operator told me that take your brother with you at the time of interview .and keep all documents ready ,CO will determine cspa legibility .

on facebook i got this reply : "Thank you for writing on our visa tab. Certain visa applicants over the age of 21 remain eligible for immigrant visa issuance under the Child Status and Protection Act (CSPA). However, eligibility of an aged out applicant is determined by the Consular Officer at the time of the family’s interview. The family should only bring the aged out child’s original birth certificate to their interview. At that time, if the eligibility of an aged out applicant is determined by the Consular Officer, he or she will be scheduled for an individual interview. Applicants should contact our panel physicians directly to make an appointment for the examination only after they receive their interview appointment letters."

then i email consulate for revised interview letter. i got this reply

"Dear Sir:

Thank you for your inquiry. CSPA will be determined at the time of the parents interview. IF he is eligible parents will be informed of the same."

Thank You

Savvy Boy

Taha
