ya..thnx :)

you are next :)

I'd like that but, im probably atleast 2, 3 visa bulletins away!

which actually brings me to the question regarding CSPA and retrogression.

The date from which the CSPA is calculated starts from the 'filing date' of the I-130 right? Because our filing date is different than our priority date and one of our derivative beneficiary's adjusted age is in a bit of a mix, but adding the 9/11 adjustment and the difference between the filing and priority date may just get him still eligible if we're current on March 01, 2013. That is if they conclude that we hadn't "sought to acquire" an IV before the infamous retrogression of 2011.

So my second question relating to that, the different articles online say that the BIA has a given a very broad definition of "sought to acquire". We filed the DS-230 after the retrogression but paid the relevant fees long before that. Do you all think we've got a real case here?? Because, I do...

hello,

i am roshan bano, i am primary applicant and my brother applied for me. along with me my daughter n husband were also eligible we hav given interview in the month of jan 2011 but since thn our case was in AP. after writing many letters to embassy first they told us tht me n my daughter are clear frm AP n they ask 2 send fresh DS230 form and medical we sent those doc. but we haven't receive any answer. we again wrote letter n this time embassy called us n said tht me n my husband are clear frm AP and my daughter last AP was expire so they put her case in AP again. they also said tht they r ready to issue visa 2 me n my husband but we hav to leave before 5 january 2013 as our passports are getting expire in April. so can anyone tell us tht is it possible tht without 6 mths validy of passport we can travel? although embassy person told us tht yes we can travel. secondly my husband haven't done his fresh medical exam as previously the ask 4 me n my daughter's medical only. so does it will create any problem for my husband? plz share ur views.

thnx

well congrats first of all. the best answer to that can be given from the embassy. but i think its better to get your husband's medical done again, the embassy might have issued the visa to him but you could run into some unwanted trouble at the Port of Entry upon your arrival in the US.
