hello guys, my interview is scheduled on 25 jan 2013 at mumbai consulate.

my mom is principal beneficiary , my dad ,me and my elder brother is derivative beneficiary of petition but unfortunately my brothers name is not included in appointment letter .but he qualifies under CSPA law.and my immigration lawyer and nvc operater told me to take him with us at consulate and represent cspa docs and other civil docs in front of consular officer....so that co will take decision on cspa.

we are not able to do his medical right now bcoz his name is not included in appointment letter.so i think mumbai consulate will issue 221(g){blue sheet i think } letter for his medical.so my question is will lilavati hospital allow him for medical on basis of 221(g) ??

his name is there on document cover sheet , 404$ fee receipt and in checklist(rfe) .we have also submitted his all civil docs at nvc.

guys plz help. i appreciate your inputs. if any one know about it ? plz tell me..

Three persons on this thread told you what to do to get an revised interview letter with you, your brother, mother and father's name on it. Did you do as we instructed with emailing the consulate? I told you NVC CAN'T HELP YOUR CASE AT THIS STAGE and unless the consulate told you this, your lawyer is looking for the easy way to solve your problem.

The medical office has to do whatever the consulate says.

See, you need to write in a very simple words that as per CSPA act your brother is eligible for the visa. I had experienced this one personally in 2010 when my brother's name had not been included. Consulate people are very genuine they will re-examine your case and surely include your brother's name if he is eligible. There is no harm in writing a mail before interview also.

Priority Date : 18 JUL 2001.

Interviewed Once : DEC 2010.

From : India.

btw guys..us consulate mumbai has started new visa tab where people put their query and consular officer ans their query.

i also put my query yesterday about my elder bro cspa and medical.i got this reply .

"Thank you for writing on our visa tab. Certain visa applicants over the age of 21 remain eligible for immigrant visa issuance under the Child Status and Protection Act (CSPA). However, eligibility of an aged out applicant is determined by the Consular Officer at the time of the family’s interview. The family should only bring the aged out child’s original birth certificate to their interview. At that time, if the eligibility of an aged out applicant is determined by the Consular Officer, he or she will be scheduled for an individual interview. Applicants should contact our panel physicians directly to make an appointment for the examination only after they receive their interview appointment letters."

Well there's your answer. Do as it says. The CO will make a decision at your interview, then your brother will get his own interview date & letter so he can do his medical then attend his interview.
