OUR PD IS MARCH 29 2001

APPROVAL DATE IS MAY 5 2002

DOB OF MY SON IS 08/14/1990

Your son is not eligible under cspa for immigrant visa with you but when you will get your LPR then PD retention LAW will be apply to his I-130 which You will submit for her under F2B.

Approxmatly it will take 3 to 6 months for approval from USCIS. so when you get your lpr then immediate file i130 for your son.

GOOD LUCK

You are ofcours CSPA protected because that 8 years will be minus your current age whatever in January... don't worry you are full time protected.

my son's name is on the I/L yes,but he is 22 years and 3 months, and my case was completed on April 7 2011,was not current before retrogresion

Sorry not Jan 2010 but 2011. Looking back to the Dec 2010 VB the F4 PD was Jan 2002 which means you were current, you may not have gotten an I/L but your PD was current.

I'm a bit confused because I read that ages are frozen once a case is documentarily qualified by NVC and with the retrogression that happened, your case would have to be completed before Jan 1, 2011 for your kids' ages to be unaffected by said retrogression. I could be wrong since your son's name is on the I/L. Go ahead with his medical & PCC and hope for the best. CSPA can't help if your son's age is not frozen, do you have a lawyer covering your case that you could ask what is happening?

SHE said her case was completed since April 7 2011 ok and if her son DS-230 was submitted before jan2011 then he is eligible otherwise not.

NEWS ABOUT IMMIGRATION REFORM

it seems that many Republican members of Congress are not about to change their negative positions on immigration despite the election results. The good news is that if even a couple of dozen Republican Representatives vote for CIR(Comprehensive immigration reform), it could become law in 2013. However, whether Boehner can persuade enough of his caucus to support CIR remains to be seen.
