HELLO EVERY ONE

I HAVE APPLIED IN F4 CATEGORY AND PD IS 06/07/2001 AND I HAVE COMPLETED THE DOCUMENTS SINCE APRIL 2011 CAN ANY BODY TELL ME HOW MUCH TIME SHOULD I HAVE TO WAIT?

KINDLY DO TELL ME WHAT IS "CUT OFF DATE" & "RETROGRESSION"

About 5-7 months. Chill with these guys and the wait time will pass productively. It's good for sharing the necessary information needed before your interview.

Cut off date = dates before the last person in a particular category has a visa number available. So right now the cut off date (priority date) for F4 category is January 8, 2001 meaning everyone with a priority date of January 7, 2001 and before is eligible for an interview to get a visa.

Retrogression = a roll back in the cut off dates of a particular category because supply is much less than demand. This means the small number of visas available cannot satisfy the large number of applicants.

i want to ask that who is eligible for the "CSPA"

it depends on how long did it take for the NVC to approve your petition.

For example:you petitioned on Oct 2001,but the NVC didn't approve it until 2009,after 8 years the NVC sent you a letter:"...we have approved this immigration petition of Familiy Category IV...etc"then you children can immigrate with you even if their age has exceeded 21, your children can immigrate with you even if their age has reached 29.(Unmarried please remember)

i want to ask that who is eligible for the "CSPA"

Eligibility Criteria:-

  1. Must be the beneficiary of a pending or approved visa petition on or after August 6, 2002.
  2. The beneficiary must not have had a final decision on an application for adjustment of status or an immigrant visa before August 6, 2002.
  3. The child must “seek to acquire” permanent residence within 1 year of a visa becoming available. USCIS interprets “seek to acquire” as having a Form I-824, Application for Action on an Approved Application or Petition, filed on the child’s behalf or the filing of a Form I-485, Application to Register Permanent Residence or Adjust Status, or submit Form DS-230, Application for Immigrant Visa and Alien Registration from the Department of State. The date of visa availability means the first day of the first month a visa in the appropriate category was listed as available in the Department of State’s visa bulletin or the date the visa petition was approved, whichever is later.

September 28,2010 : NVC Receives DS-3032(E-mail received from NVC).

September 28,2010 : IV Invoiced(Online Payment Portal).

September 30,2010 : IV Fee Paid.

October 28, 2010 : AOS Packet Sent.

October 29, 2010 : AOS Packet delivered at PORTSMOUTH, NH.

November 16,2010 : AVRS says I-864 received.

November 16,2010 : DS-230 Packet Sent.

November 17,2010 : DS-230 delivered at PORTSMOUTH, NH.

December 06,2010 : AVRS says DS-230 received.

December 11,2010 : AVRS says documents missing, NVC has mailed a letter on Dec. 10.

December 18,2010 : Missing Affidavits Sent.

December 19,2010 : Checklist Cover Letter Received from NVC.

December 21,2010 : Corrected Affidavits Sent.

December 25,2010 : Merry X-Mas. AVRS says checklist response received on Dec.23; need 4-6 weeks for review.

January 12,2010 : Happy NEW YEAR. AVRS says CASE COMPLETED :)

January 25,2010 : Sign in Failed 2300 HRS IST :)
