Hi Everyone! I am new to here...

I come from Hong Kong and I am 24 right now. My father's sister is an US citizen and we just got the appontment letter for the interview on April 8th. While everyone is talking about the CSPA, I am pretty sure I am not eligible because I have read so many posts and even consulted a lawyer for this case. My priority date and the approval date from the USCIS is only about 7 months. [i was really surprised that time was that fast]

So what's next? My application process was continued in the NVC, in which they asked me to turn in the DS230 form during 2010. Until last week, we got the appointment letter and I was surprised that my name was on the traveling applicants and they have asked me to submit required body check and documents during interview.

I am getting confuse because why would i get the appointment? And, what I should tell them during the interview....

Should i tell them that i studied in the states for 4 years and I really love it? begging them to let me in? [it sounds naive]

Do the US embassy actually have the power to determine a "child" to be eligible for immigrant visa?

My whole family are worried...please... anyone can help?

CONGRATS! YOU DON'T HAVE ANYTHING R=TO BE UPSET ABOUT.you don't need to beg! if they asked you to come for interview, there is no need for begging.it is NVC WHO DECIDES ABOUT THE INTERVIEWS NOT EMBASSY.JUST GO THERE AND BE RELAXED AND PRESENT YOURSELF IN A GOOD WAY.

Thanks for your reply. But some said they will calculate whether you are eligible on the day of interview? You mean for most people who got the interview they will get the immigrant visa?

First of all tell me when you submited your AOS/Ds230?????? then i can tell you whether you are eligible or not.

So we got the mail from NVC on August 11, 2011 for submitting the documents...so we submitted everything by December 2011 - estimation?

And more information, according to my petitioner,

USCIS received the application on Apr 25 2001 and they approved on Dec 18 2001.

My petitioner has received a receipt of payment dated: Jun 28 2001

You probably got the mail from NVC on August 11, 2010. Not 2011. Thats when you're PD would've been current first time. Anyways. When did your $404 IV fee get submitted? And what is your DOB?

If your IV fee was submitted before February 01, 2011 then subtract 282 days from your age on August 01, 2010. If that's below 21 years, your good. If your IV fee was not submitted before February 01, 2011 then you might be in trouble and you'd only be making a fool of yourself by 'begging' at the interview.

According to your DATA your CSPA age over because in june 28 your age was 23 as you said you are now 24.

CSPA only applicable when your Priority date available then yoU must submit Your IV FEE OR DS-230 with in a year but the thing is These you can only do if Your age calculated under 21 by subtracting petition pending time and in your case your pending time is just 7 months so if subtract this 7 months when your Priority date first time was current in 2010 you will be calculated over 21 because in 2010 your age was 22...and if we minus 7 months from 22 then the answer calculate over 21...mean 21 years and 5 months.

just tell me your date of birth then i can exactly calculate whither you are eligible or not.

and at the time of interview visa officer will again calculate your age for cspa purpose.

Yes, that was a typo...i received the NVC mail in 2010...my DOB is Jan 23 1989 - 24 yrs old...

so IV fee submitted with DS230?

- my family handed our case to a consultancy in New York to handle...I may need to ask them for further details on the payment date...

I would just tell the consulate the truth that I really wanna stay but just the fact of my identity...I couldn't

If you already paid the fees just appear for the interview since your name is on the appointmet letter. If it happens that your are not eligible by heircaclcvulation, DON'T beg as it will NOT make an atom of difference in their decision regradless if you tell them how much you love the U.S or not . They have to follow the law and set guidelines.Just walkout with your head held up high.

What we extracted from a worksheet from NVC for calculating CSPA age which was uploaded by a follow member recently; in case of retrogression the NVC will use the initial date when the Priority Date became current when calculating the CSPA adjusted age IF the applicant paid the IV fee or submitted the Affidavit of Support or filed the DS-230 before the Priority Date retrogressed. In your case, the initial date when the Priority Date became current was August 01, 2010 and it retrogressed on February 01, 2011 and will again become current on April 01, 2013. Since you're saying you handed it over to a consultancy firm, then it is very much likely that you're IV fee or AOS or DS-230 was filed before February 01, 2011.

Now, the method for CSPA is that the age of the applicant for the purpose of immigration is:

(Age when PD became current) - (Time it took for initial approval) = (7854 days) - (237 days) = 7617 Days = 20 years 10 months and some days (roughly)

which is under 21. so you are good hence your name in the interview letter. be calm, be positive and do not argue at your interview. goodluck.
