Filing with Dependants

Timeline

We filed the I129F form 3 mths ago and left out a few things in the orginal package so now we are finally get ourselves organised and covering all bases. I have 3 dependants that we are applying for also so I'm just wondering if we need to send G-325A forms and photos of them at this first stage also? And if so, should I sign the forms on their behalf or just leave it as 'Unalbe to Sign'??? Any help is welcomed?

Are you the US citizen or the foreign beneficiary?

Three "dependents"? Are these your biological children?

Unless you get an RFE, you can't add anything to what you've submitted at this point. In all likelihood, anything you send now will never join up with your original petition. However, in order to provide any useful information we need answers to the above questions.

What is a RFE? Yes they are my biological children but not my fiances. They are originally listed on the I129F form when we first sent it in but we just didn't do a G325A for me and wondered if we needed to do that for my sons?

An RFE is "Request For Evidence".

After I posted my previous answer I saw your other post. It appears your fiance did receive an RFE for the letters of intent.

You do not need to send G-325A's for the kids at this time. The only thing that is needed is that they are listed on the I-129F, which they apparently are.

When the petition is approved and forwarded to the US consulate in your country then you will receive instructions for submitting the visa application. You will submit visa applications for yourself and any children you intend to bring with you as K2 derivatives. You can sign any form on behalf of the children if they are under 14 years of age. The instructions you receive from the consulate should explain things fairly clearly. With few exceptions, you need to submit the same things for the kids that you submit for yourself. If the kids are under 14 then they probably do not need to attend the interview.

You will probably need permission from their other biological parent for them to immigrate to the US.

You only need to list all children on the I-129f. They do not need G-325s. After sending the forms is not the time to "get organized" and cover bases. Seems as though you still haven't read the directions.

Hopefully you will do so when you answer the RFE.

Unfortunately you're right with that and it is at no fault then our own and we have paid for that in time. We had no really help prior and no real idea but this website with everyones advice is really very helpful and now we're moving forward, full steam ahead!
