hey guys

I applied for a k3 visa and its already pending , i want to visit my wife while its getting processed ,

so

1- can i apply for another visa while 1 is being processed?

2- would that be a red flag or it would be ok ?

First the K3 visa is no longer being accepted at the NVC.

You most likely will not be able to get a tourist visa from Egypt so I would not take the chance and apply. Focus on getting approved on your marriage visa.

You won't be approved for a tourist visa if you are married not to mention it's very hard to get one in the first place. Save your money and wait for your visa to be approved. Then you can just move to be with your wife. :thumbs: Check out the guide for CR-1 visas and the timelines.

Just be patient, it's hard but worth it! B-)

well...i made the topic to ask , why wouldn't i be approved ?.. i will have to go back for the immigration visa ..why would i live illegal in the US when i can live legal ...that can prove 100% that iam coming back to my country after the visit .

Your questions are " can I apply " & "is it a red flag"?

Yes you can apply & yes its a red flag. Like everyone you can choose to pay the fee which puts your case at the discression of the interviewing officer. You will be asked if you have ever applied for a visa. Having a pending immigrant visa will be the deciding factor & you will be denied. Even if you were approved you would likely be turned away at the POE when they realise you have a pending visa application.

If you gained entry into the USA you would not have to return to become legal. That is exactly the reason you wont get a tourist visa. That & the fact Egypt is a high fraud country where it can be very difficult to get a visa.

I believe you would go back to interview for the immigrant visa. I would have as well but I was denied for the exact reasons above.

You came here for info & advise. The other members & I have given you the best advise we can based on the experiance we gained. Accept the advise & save your money is the most prudent thing to do. If emotion compels you to ignore that advise you can pay the fee & have the experiance injected at a higher cost.

Yes you can apply for a visa, and no it would not be a red flag on your current immigration visa. Many people have received visitor visas during the immigration process, but the key is that you need to show strong ties that you will be returning to Egypt and completing your immigration visa. Strong ties would be a lease agreement, letter from employer, bank statements, etc...

Like others have stated, the chances of you getting approved is very slim. Unfortunately its difficult for a male from Egypt or any middle east country to get a visitor visa even if he doesn't have a pending immigration application. If you want to try it, give it a shot, but if you're expecting them to take your word that you will return after your visit, then I wouldn't get your hopes up, you will need strong evidence to support your word.

Also, as someone else stated, even if you were approved at the interview it is always up to the discretion of the border officer to let you in, you could invest in the money for the application and a plane ticket, to only come here and have them send you on the next flight back. They can do this if they feel you are at risk for immigrating illegally, that is why it is difficult to come when you have a pending immigration application and the strong evidence of your returning is needed. If you do decide to go thru with this, and make it to US soil, make sure you bring all that evidence with you or you will not make it out of the airport.

It is possible to adjust status from within the US from a tourist visa by marriage to a US citizen. Hence not only will you have to overcome the difficulty of showing your ties to Egypt to obtain a tourist visa (which is very difficult to do in several countries, Egypt being one of them) but you will also have to overcome the suspicion that you will come here and decide to toss the K-3 out the window and apply for direct adjustment of status while you are here. Since Egypt almost always applies Additional Processing to young, male applicants which can add weeks or months to the visa process this would be another good reason that a person might decide to take the "tourist visa short-cut".

Certainly you can apply but the chance of approval are almost zero.

My husband is from Morocco and we know of several of his friends who have tried for tourist visa'a and all have been denied and I know of one who did it while his CR1 was pending and it was denied and he was given all kinds of issues at his CR1 interview. The fact is that they just don't give out tourist visa's I have even known of people trying to get their elderly parents a Visa to visit and get denied. So sad but true! It is costly to apply for the Visa now especially since all the prices went up double or triple this month for Visa's not sure if tourist was one of them.

hi,

I just want to get help.. I applyied tourist visa 3 time and they denied me 3 times.. they always told me that I dont have a strong ties to my own country even though I have a lot of bussiness in my own country, i have my bank acct. in my own name I have a land tittle in my own name and some in my parent I have 3 cars, and some wheels and trucks for my bussiness. The reason why Im appplying for a tourist visa is only to visit some of my cousins in new jersey and go for a tour. I been in a lot place in asia like hongkong, singapore ect. and still I dont get it why they always deny me...

can I get some help or advicce what should I do next for my application?

I have my CR1 pending, and I applied for B1/B2 2 days back and it was approved.

It was approved on bases I was going for work and was not intending to commit fraud, on top of it consular could see I had lived in US in past.

Infact at the time of issuing me the Visa she kinda adviced me to take all the CR1 documentation, so that I would not be given hard time at the POE.
