My husband came over on a k-1 visa.In the POE he was told he could apply for a ss#,can he work or does he have to wait until we do the I-485?

July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well, they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit, nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !

As i know that it will depend on the place he would work at .

WARNING : Don't let him do any kind of work under the table .(working without documents )

Beautiful patience.

He must have a valid EAD or greencard before he can start to work. The SS card is proof of identity only can does not give authority to work. My infant grandson has a SS card and per child labor laws his mother would be in big dodo if he was working ( except in the modeling/acting industry)

This will not be over quickly. You will not enjoy this.

A K1 can get a Social Security number only while the I-94 is still valid (the first 90 days after arrival). They won't issue the number the first couple of weeks after the K1 arrives (their name won't be in the computer system yet), nor the last couple of weeks before the I-94 expires (not enough time left). So, you've got about a two month window of opportunity to get the number and SS card. If you don't get it during this time then you need to wait either until he gets his EAD or green card.

Read the VJ guides for applying for an SSN here:

http://www.visajourney.com/content/ssn

The Social Security number a K1 receives during the 90 day window cannot be used for work. In fact, the card will be stamped "Not valid for employment without DHS authorization", or something similar. It is valid for opening a bank account, filing a joint tax return with US citizen spouse, etc. Once you get the EAD or green card then you can get a new SS card without the employment restriction.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
