Hello, I am wanting to know about what to do about sponsering some one here to america?. My daughter lives with and has had a baby from a man from Mexico who now is illegal, he was once legal but his papers expired and he can not afford to go thru the process to make him self legal? Can I sponser him or what do I have to do to get him legal here?? Do I have to be making a certain amount of money to quilify to do this?? Gary

I guess the first question is - what was his legal stataus, as in how did he enter the US? Is your daughter a US citizen?

But I can tell you, you cannot petition for in-laws. If anything is to happen, it will be your daughter that has to do it

Here's the short list:

1. He must have entered the US legally (there are a few unusual exceptions to this).

2. He must have not broken any laws while he's been here. Overstaying his entry pass and working without authorization will not be held against him, nor will any traffic infractions.

3. Your daughter must be a US citizen.

4. They have to get married.

If the above conditions can be met, then YOU can be a joint sponsor for his green card application. Your income must be 125% of the poverty guidelines for the size of your household, which includes you, anyone you support, and the immigrant. The guidelines are here:

As canadian_wife said, your DAUGHTER must be the primary sponsor. Only an immediate relative can be the primary sponsor, and she'll be his immediate relative once they are married. However, if she can't meet the income requirements then she can have a joint sponsor who does (this means you).

You'll be signing a legally binding affidavit of support. Don't take this lightly. It puts a rather serious legal financial obligation on you. Read the form's instructions, and especially the contract portion of the form so that you understand what you will be agreeing to:

If he had a work visa his Employer would have renewed it.

If he has a Green Card the card may expire, the status does not.
