You can refile another k1 but you need to know what they denied you for....

Possible red flags:

Age difference

Religion

You having any relatives in the USA

Financial status of the USC

Time having known each other

Filing after meeting only once

Prior marriages

Any attempted visa's prior to filing the k1

Put yourself in the Consular Officer's shoes and think what made you get denied

You have to address everything

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

Hi everybody,

I do not know what to say,but after our K-1 case was returned,today we get the letter from VSC saying that the validity was expired and the case was closed!!It is very hurting,so please can you give me any other solution,is it possible to refile a K-1 again with the same first pictures and first tickets of my first visit??I hope you can reply me as soon as possible and thank you so much..

I am just curious about how long you knew eachother before the first visit? And how long was the first visit for? Is there anything keeping her for going to visit you again before you refile? In my opinion if it was me and my husband getting denied like that I would plan a new visit and give it a bit of time before I refiled. Spend some time together take some more pictures and have more documentation of a 2nd trip there. It shows commitment and stability in my opinion. I know you are anxious to be together just like I am with my husband but sometime a longer getting to know you and engagement period can work in your favor! Just my thoughts inshallah everything turns out for the best!!

it is possible to request the interviewers notes from the interview. I found this info by accident online one night. I can't tell you exactly how to do it now but when I find it I will post it. I do know you have to write a letter requesting the notes. Our letter that he received from the consulate only had other checked as the reason for denial/review...... I think your best bet would be to legally marry in Morocco and file the CR-1 because like someone said before the USA would gladly take your money as many times as you are willing to give it..... So do the CR-1 and make harder for them to deny you.... We haven't received our letter from the service center yet but if they close our case we will just marry in morocco file the CR-1 and pack it with lots of evidence and letters from friends and family..... My first instinct was to file the CR-1 in the first place but against my better judgement I listened to others and filed the K-1 which really is a waste of time, money and energy...... They should do away with it all together.....

I also feel the K-1 process is a little more difficult for muslims..... There really is no such thing as engagement or boyfriend/ girlfriend relationships in Islam..... And the so called "engagement party" is really a wedding party from what I have read of the moroccan culture........

Awesome...thanks for the info. I've heard of the FOIA, but was told they didn't really get anything of use, but it looks like if you request the notes from the interview that would help get the correct info. An issue I see is that I was told that any request put on the case holds it up...but i guess if its going to or is expired already any way...lol :wacko::bonk: this whole process is crazy.

I had requested a FOIA and then after 10 months of waiting my Senators office told me it was holding up our case to be reviewed. I never got the FOIA and any review on my first k1. From what I heard it's very rare to find out the consular's notes(at least from Morocco).

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

The request may hold up the review but keep in mind that your applcation would have expired any by the time it has been received by the service center for review in the first place. Sometimes the service centers will ask for additional evidence but more often then not they will just close the case so having the notess will be helpfully in letting you know why you were denied in the first place better preparing you when you file again but if anyone finds themself in this position I would advise not filing another K-1 but to marry in morocco and file the CR-1. Having the notes will help you here as well allowing you to be more prepared for the interview. Having a Moroccan marriage certificate and the knowledge as to why you were denied the first time under your belt can only help you :0)

I visited my "fiance" husband twice in a 10 month period. we met in Feburary of 2009 and I visited the first time in september for 3 weeks and we had our party about 4 days before I left. My second visit was april/may 2010 for 5 weeks. his interview was april 26th I git there a couple of days before.... He was not told anything just to come back 3 days later.... But it was odd to me because usaully if you are approved they ask for your passport and tell you they will call you. So I called but got nothing. 3 days later he went back and was given a letter saying he was not eligable and other was checked as the reason. I called again and told them I was there in Morocco and would like to try to clear any issues up while I was there and still I got nowhere I was told I needed to request info via email so I did I was then told that our application was sent back for further review...

Really I think the whole process is a money mill.... I would strongly suggest you request the consulates notes from your interview so that you know why you were denied before you pay another fee to file another application. The US government will keep on taking your money..... And if you are able to go back for a visit I would suggest just getting married while you are there. I hope everything works out for you :0)

And also I thought I would mention that the fee to apply for a fiance visa has went up this month and I think it is now cheaper to do the CR1 for sure in my opinion even with the running around to get marriage documents completed it comes out cheaper. So if you are planning to go to Morocco again marriage might be the best route.
