DCF 864doc question

Okay, I brought my I-130 to the U.S. Embassy in Brasilia, Brazil. It was accepted and mailed to Rio de Janeiro. A few days ago I emailed the Rio consulate asking for a status update. They informed me that my wifes interview is scheduled for October and that a letter should be arriving in the mail shortly explaining everything. We dropped off the I-130 on June 28th, and her interview is Oct 21st. So about 4 months. Not bad at all.

Now, my question is this. I have been in Brazil for a very long time and therefore have no income to show on the 864 document. My father is going to be the cosponsor though.

So I fill out the 864 and say I am umemployed, and then my father fills out the 864A, correct?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Would you file an I-864a if you were intending to move in with your cosponsor on arrival? Or would it still be 864, as you do not currently live with them?

yeah this is a better question. my address is currently the same as my fathers and we intend to live with him for a little when we arrive to the states.

sounds like we are both seeking the answer to the same question. Hopefully someone can help us :unsure: I have recieved conflicting information, some people say us 864a if you are going to live with them, others say its 864 cause you arent living with them yet.

I've had the same issue and I keep getting conflicting answers as well. If the USC is going to move to the US prior to the intending immigrant, then it's clearly the I-864A as they're considered to have established US domicile.

If you are planning on moving together and entering the country on the same day, then it's more complicated.

What I'm going to do is have my co-sponsor fill both forms and see which one the Officer at the interview asks for.

Aug 2, 2010 - I-130 package mailed to the London Consulate (DCF)
Aug 9, 2010 - NOA1 (confirmation of receipt) via email
Sep 4, 2010 - religious wedding

Nov 29, 2010 - Medical
Dec 1, 2010 - DS-230I & DS-2001 forms mailed back
Feb 1, 2011 - Interview - APPROVED!!!
Feb 7, 2011 - Passport with Visa received via courier
June 7, 2011 - POE Los Angeles (LAX)
June 18, 2011 - 2-Year Green card received in the mail!!!

My ROC journey:
April 2, 2013 - I-751 package mailed to California Service Center

April 3, 2013 - NOA1 date
April 8, 2013 - check cleared
May 6, 2013 - Biometrics completed

July 25, 2013 - 10 year green card APPROVED!! (notification via text and email, and website updated)

July 29, 2013 - ROC approval letter received in the mail

July 31, 2013 - 10 year green card received in the mail!!!

My N-400 journey:

March 19, 2014 - N-400 package mailed to Phoenix, AZ Lockbox

March 24, 2014 - NOA1 date and Priority Date

March 27, 2014 - Check cleared

April 21, 2014 - Biometrics done

May 7, 2014 - In line for interview

June 23, 2014 - Scheduled for interview

July 28, 2014 - Interview - PASSED!!

July 30, 2014 - In line for oath

July 31, 2014 - Scheduled for oath

Aug 27, 2014 - Oath ceremony, I am a US citizen!!!

again , NO... the I864A is intended for a co-sponsor that needs additional income to satisfy the poverty limits for example if a husband and wife living in the same household were to be co-sponsors, the husband only makes 12000 per year and the limit is 18000 then the wife could add an I864A for the additional 6000 needed, You would not do an I864A because even if you are intending on being in the same household in the future, you are not now so technically you are separate households now with future intentions of being a single household but DOS only considers current situations with future projections considered on ability to provide future income
