Yes, I remember that thread well Sus, as I was GLUED to it to find out what happend with Sam & Rasta... the difference is the embassy has the proof of his prior criminal history. We went before the embassy on our K1 visa with 2 prior charges of possession, AND we admitted to those charges on the DS230.

the admission ALONE makes him ineligible for a waiver... Through the JA legal system, he is eligible for expungement May 2013, but that will not change the fact that the embassy already knows his criminal history :(

No Mrs.P our cases are different... We would not file a waiver until AFTER the I-130 was denied anyway... what I did was consult with an immigration attorney to see if we would even qualify for a waiver because EVERYTHING I have read about immigration law says 2 charges for MJ possession CANNOT be waived, and I was right :(

I wanted to find out BEFORE I filed so I did not waste the time and money filing when a waiver could not be obtained...

TO clarify for Mrs.P why our cases are different...

Your hubby's denial and ban was based on him needing to be clean for 3 years.

My hubby's denial is based on criminal history for conviction of possession of a controlled substance.

Apparently the way the laws were re-written with the "war on drugs" he would have a better chance getting here had he committed armed robbery :wacko::protest:

I'm so sorry for what has happened to you. I truely feel your pain what I would do is contact another attorney and get a second opinion.

JQ tell me about it--it really can get to be a little ridiculous. Now don't get me wrong, I understand that they are really working to try to keep people out who would be/could be detrimental to our society out...but really...this subject burns my rass up! All mine did was admit during a physical that he had last smoked a couple of years EARLIER! Hell, all his tests were clean--and he was still denied and labeled an "abuser" in the denial letter! Exactly - and did you see the recent poster from JA whose hubby admitted to last smoking Dec 09 - and they got a letter to do a new medical and come back for a 2nd interview after Dec 1 this year!! Not that I wish bad for her - But why did you and Yankee get screwed if he gets through? The inconsistency is horrific

Not to mention.....they say the embassy will be closed for the hurricane or tropical storm WHATEVA...from TOMORROW til Monday but not get back on normal schedule till the following monday...#######???? Yes, I did email them...NO ANSWER...so, not sure if Michael will have his interview as scheduled on 11/12 or not.....so damn frustrating!!!

Oh... :crying: Well in that case...let me know what kind of work you would want to do...I could help you look for stuff down there. Back when we were going through our ####### I was contemplating a move down there and started gathering alot of information about different agencies, work eligibility/visa requirements, etc...I may still have it packed away somewhere. Hope u all can be together soon mamacita! And remember, we ALL have your back! I know I do...and I'm ready to jump all in! (L)

Girl...from what I told it's based off of what the Co at the time thinks is appropriate. There is no set standard or rule they have to follow! They can literally dictate your life based on how they may be feeling that way (really there's no way to guarantee objectivity) :angry::angry:
