A woman who entered the country with her birth mother at 3 years old without inspection is now facing deportation. She was adopted by US Citizens after being taken from her birth mother because of abuse. Her parents were told by the state that she automatically became a citizen once adopted, so her immigration status was never settled.

Given that many Americans, even after interacting with an immigrant and hearing a short precis of their story, still think that legal immigration is as simple as "get married, become US citizen", it's not hard to understand how the adopted mother would have accepted what a DHS employee said. It's unlikely she knew the difference between DHS and INS/USCIS anyway...

Exactly... as part of the final adoption ... why didnt she request copy of the child's birth certificate, Social Security CARD! I'm certain she knew the child was from mexico since she had backgroung info that the child was taken in the usa illegaly.. JUST WHYYYYYYY DIDNT SHE INVESTIGATE THE CHILD'S IMMI Status and since "DHS" took her for a reason.. abuse they say..? from the illigal parent... this new mom is just as blind as a bat..

"....DHS told me that she is a citizen once she is adopted by a usc...." Reply - thats good news, how do I get poof of US CitizenShip... again... Do you hace Her Birth certificate, her SSN?, other supporting documents... this is crazy... Did she just jump into adoption WITHOUT "KNOW-ING THE CHILD?"

I definitely agree that the mother should have asked more questions, gotten proof, etc., but I can also understand that most Americans really have no idea how immigration works or even what proof of citizenship is. Regardless, the daughter should not be punished because her mother didn't know what processes were involved or assumed that DHS did everything as part of the adoption process.

As an update, the woman is getting a U visa (for crime victims) and will no longer be deported.

looks to me like DHS did not read the complete law that allows a child from another country to become a citizen of the usa..........first the child has to be adopted an enter the usa as an adopted child then readopted here in the states at least that was the case with my citizenship......i just love it when departments of state (dont matter what one) give out a lot of half true facts and think they have given the usa citizen the correct answer!

just my opinion

I don't know about US adoption law but don't you get a new birthcertificate after the adoption that makes the adopting parent/s the "only" parents? Like that you just get a SSN and passport?

At least that's how it worked when my parents adopted my brother, they are on his BC like he never had a different mother and father. Whenever they applied for passport,...nobody would even guess he was not the biological son.
